Hawkins: Trump White House Declares Support for Gun Confiscation Orders

The Trump White House released policy papers Monday declaring full support for California-style firearm confiscation orders. Breitbart News has a copy of the release and it urges states to adopt Extreme Risk Protection Orders (ERPOs). Such orders allow firearms to be confiscated with a judge’s approval.

The White House suggests that ERPOs “allow law enforcement, with approval from a court, to remove firearms from individuals who are a demonstrated threat to themselves or others and temporarily to prevent individuals from purchasing new firearms.” They stressed that the orders “should be carefully tailored to ensure the due process rights of law-abiding citizens are protected.”

California adopted similar gun confiscation laws in 2015 and Southern California Public Radio reports that 190 orders requiring confiscation were issued 2016-2017 alone.

This will work in mental cases like Nic Cruz, with scores of reports, but requires avoidance of negligence, from Middle School up to state bureau of FBI.

Not sure Florida is competent enough to handle one teen aged bad boy, in ANY case.

See them all skate?

It’s my understanding that all such Red Flag order require a court/judge order.

They just don’t require a hearing where rules of evidence and counter argument are required.

I believe this author is mistaken, at least.

If done via a judicial order, with due process, what’s the problem. The key is due process to ensure that victim of the seizure has his constitutional rights respected. If a person is declared incompetent, for whatever reason, take their guns, give them their day in court to sustain or rescind the ruling. If you don’t like this, and I realize the devil is in the details, explain a better way to ensure that people who should not have guns, do not have them?

The article currently reads "with a judge’s approval" not "without court order".

That's what ERPOs don't do - the orders are ex parte.

And what is the point of your query? Maybe they don’t have much to say. Or you bothered that they post so infrequently or that they bring up a potentially inconvenient topic? Calling them a troll doesn’t change the substance of the Breitbart report.
