I really should sit down to some digging but, I wonder if any court case(s), up through SCOTUS, remind the judges of such?

I suspect they gloss right over, as they do the last 1/2 of the 2nd, or will it away w/ the ‘compelling State interest’ canard (as if govt *power* trumps an inalienable Right).
