Trump administration announces more H-1B restrictions

In a move that particularly targets Indian tech workers and IT outsourcing companies, the Trump Administration on Friday announced stricter requirements for companies that rely on H-1B workers.

U.S. Citizenship and Immigration Services said in a new policy memo it will require “detailed documentation” about H-1B workers employed at third-party work sites to ensure employees are filling a specialty role for which they were hired.

Something they don't advertise at Facebook, Google, Apple, etc. Don't want any of those multi billionaires to lose income do you?

Of course there are American born students at Georgia Tech, Montana State, Colorado, UCLA, Oberlin,...etc that would love to do these jobs.

H1Bs not only depress wages, they eat the seed corn of the next generation.

If they simply adhere to the law as written and intended, 99.99% of H1-Bs would be sent home tomorrow. None of them have skills that are not available domestically.

It might only be 98.5%, but your point is well taken.

The Japanese simply require that foreign workers be paid a wage premium of 10% or more over natives doing the same type of work (accounting also for similar education and years of experience). That simple formula works wonders. For 14 years, I enjoyed my time there. Eventually, I became too much like the natives and was no longer worth the wage premium, so they moved me home.

My brother, OTOH, is a permanent resident because he has a special skill which the natives cannot duplicate.

My daughter is an experienced programmer/software developer in the tech industry in California. She runs into the discriminatory issue against American tech workers and in favor of bringing in Indian H1 Bs all the time. Generally these US based contract houses are Indian looking to hire cheaper Indian talent for their American corporate clients. They will interview American talent as a cover with the knowledge that ultimately they will be bringing in Indian H1 Bs from overseas. Obama never stopped the ruse because the Silicon Valley was one of his major backers. Great having a new sheriff in town to clean up this charade.

Spouses of Indian and Chinese tech workers could be stripped of right to work in U.S.

Tens of thousands of foreign nationals living legally in the United States could soon lose government permission to earn a living while they are here.

The Trump administration could end a program as soon as February that allows the spouses of legal foreign workers, mainly tech workers from India and China, to obtain their own work visas.

Silly Con Valley imports foreigners to take these jobs in USA — while the firms won’t hire — many qualified Americans, some very well qualified . ( meanwhile, the government and many schools are trying to steer, talk students into STEM degrees that lead to unemployment and welfare or jobs tossing cheap burgers out of windows ). Go figure!! At least many students can see through this, don’t get fast- talked into difficult curriculi that - all so often — are as worthless as liberal arts degrees in the REAL hiring world 😸😹

This provision was for the Werner Von Brauns of the world, the rocket scientists. Not for plug and play computer scientists. Capitalism has in fact gotten so capitalistic that the mores of domestic business have been forgotten.

Sad to say, that is not so. From http://cis.org/miano/primer-reporters-looking-h-1b-program:

H-1B Is Designed to Allow Employers to Replace Americans with Cheap Foreign Workers

Replacing Americans with H-1B workers has been going on at least since 1994.

In 1998, Congress responded explicitly by making it legal for employers to replace Americans with H-1B workers. Under the current law an employer may replace an American with an H-1B worker unless:

  1. The H-1B worker is paid less than $60,000; and

  2. The H-1B worker does not have a graduate degree; and

  3. The employer has more than 15 percent of its total employees on H-1B visas earning less than $60,000 and not having graduate degrees; and

  4. The replacement takes place within 90 days of making the visa petition.

You have to navigate through two levels of misdirection in the code to piece all this together. Congress went to a lot of effort to ensure employers can replace Americans and to hide that fact from the casual reader of the code.
