Not always, but we would be in an immensely better situation if Grassley had been the Senator chosen as AG instead of Sessions, for example.

I hate to disappoint you but much of what this nut is propounding is just simply flat out wrong as a matter of law. This idiot obviously is not a lawyer and that is why he thinks he can get away with intentionally misstating the law and the legal process. Putting aside his pro trump conspiracy theories, that few if anyone else accept, he simply doesnt know what he is talking about.

And before the uninformed start in, I have been a trump supporter since Day 1. I am not a democrat clinton obama troll. Nor am I am member of the gop dirtbag establishment or Deep State. I am merely an extremely conservative attorney who knows crap when I read it.

If you have an honest AG who isn’t compromised by a conflict of interest then you don’t need a special counsel.

But then justice wouldn't have been fully served. And won't be until some DOJ agents are arrested, not just lose their jobs.Exactly, we are beyond committees and special this or that. What we need is action with a grand jury.

Where is that in the Constitution? The reason why we have elections is to elect a chief executive...a commander in chief...a big kahuna. He is the top AG. Got it?

A special counsel appointed by the president has no authority under U.S. law. He can't even subpoena a single witness or compel anyone to turn a dirty rag over as evidence.

Go back and look at what I suggested.

If the legal work is carried out by defense attorneys, they effectively CAN function as a "special counsel" in uncovering evidence. Because they are defending people in criminal cases, their clients have broad rights under the U.S. Constitution to access information from the prosecution in the interest of defending themselves.

I’m an idealist and I hope a lot; your logic is sound and I don’t question you...I would ask, however,

Is it possible Trump, et al, have stuff on Mueller that is forcing Mueller to be an artificial white hat against his wishes, and will get stuff done he didn’t intend? Like Clinton being investigated? I think so.

Legally, he courld order his AG to appoint one, as under current law it must be the AG or Deputy if AG is recused. Politically, this is frowned on, especially if target is enemy of the President. In this case though, the DOJ is an enemy of the state, so even politically it should be acceptable for Trump to order Sessions to do it, and fire Sessions of he refuses. RINO Senators that might impeach would be his biggest threat against doing so, and they have made their voices heard on this or similar themes already.

Sessions idea of action is to send the Nunes memo to the IG for more investigation.

If the President of the United States went out and appointed someone with no oversight as a “special counsel,” I can assure you the dude would be laughed out of court the first time he tried to compel a witness to appear.
