After hearing the prosecutor and the defense attorneys, I think perhaps the State threw the case. They were more concerned with their liberal shit than Kate Steinle. Every benefit of the doubt.
In our criminal system, the jury doesn't usually get to do the sentence (capital crimes excepted, where there is a penalty trial after the vwerdict). The judge gets to do it. In a sane country, the judge would take every aggravating circumstance that the jury was prevented from hearing about (six illegal border crossings, seven felonies) into consideration as aggravating circumstances on the gun conviction, and sentence him to the max.
But, after listening to attorneys from both sides, I don't think Justice is sane in California.
As Norm Macdonald said on the SNL Weekend Update after OJ’s trial, “murder is now legal in California”.

The jurors were not allowed to know any of the facts that he was an illegal or that he had been deported a bunch of times.
