seriously?!...Trump has been hounded for a year about a comment he made while joking around...Franken is posing for a photo while touching the breasts of a sleeping woman...who now comes out and slams him for sexual harrasment / borderline assault ...no this is not going to fly.
What Franken did was to humiliate her in front of her peers using sexual innuendo. That is intended to cause others to take her unseriously. It wouldn't be "goofing off" if it were done to a sleeping man, hence the sexual nature of it.
It is sexual harassment in the workplace, intended to demean her and harm future opportunities if the others "in on the joke" are ever in a hiring position over her in the future.

I'm pretty sure you would feel differently if you were her or she were your wife or daughter. You can bet that photo was shared widely and a bunch of people had a good guffaw about it. It is, in fact, sexual battery (battery is legally defined as an unwanted touching) that could be prosecuted if the statute of limitations hadn't passed.
