Judge in Chicago refuses to alter ruling on sanctuary cities

A federal judge in Chicago on Friday refused to alter his previous ruling barring Attorney General Jeff Sessions from requiring sanctuary cities nationwide to cooperate with immigration agents in exchange for receiving public safety grant money.

In granting the preliminary injunction last month, U.S. District Judge Harry Leinenweber said Mayor Rahm Emanuel’s administration could suffer “irreparable harm” in its relationship with the immigrant community if it were to comply with the U.S. Department of Justice’s new rules. The judge also said the attorney general overstepped his authority by imposing the special conditions, agreeing with the city’s argument that it was an attempt to usurp power from Congress over the country’s purse strings.

In a motion filed Sept. 26, Sessions asked Leinenweber to narrow the ruling to apply only to Chicago, arguing it would unfairly punish smaller cities that depend on the Edward Byrne Memorial Justice Assistance Grants.

But Leinenweber wrote in his decision Friday that the “rule of law is undermined” if he allowed Sessions to continue what is likely unconstitutional conduct in other cities while the lawsuit here is pending.

“An injunction more restricted in scope would leave the Attorney General free to continue enforcing the likely invalid conditions against all other Byrne JAG applicants,” the judge wrote.

A separate appeal of Leinenweber’s preliminary injunction is pending before the 7th U.S. Circuit Court of Appeals in Chicago...

Why isn’t Congress taking care of this simple matter?

Funny, but I don’t recall any Constitutional authority for Fedzilla to ‘pay’ the States for XYZ; let alone the State(s) to pay for any number of extra-constitutional programs/decrees/acts/etc.

But what Sleeping Sessions CAN do is arrest & prosecute those govt employees that are aiding and abetting criminal activity (aka illegals) as they lose their ‘govt protection’ by breaking the Law.

Course, I don’t see anything but pussy-footing from the DOJ\AG\etc. anyway...

Generally, the Federal Government cannot require local law enforcement authorities to enforce federal laws. What they can do is require such compliance in exchange for federal aid. All local governments are today heavily dependent on federal aid. They should not be, but they are.

How many divisions does this fascist pig judge command? At best he has two or three fat-ass US marshals, nearing an undeserved retirement check, squatting in his courtroom like jellyfish, drinking coffee and eating doughnuts by the truckful.

BIG difference between ‘enforcing Fed law’ and ‘violating Fed law’.

Course, the whole dog-n-pony show must continue. I don’t see State(s) failing to forward the tax $$$ (let alone suing on A1S8/9th/10th grounds), I don’t see Fedzilla voiding State XYZ ID/licenses for any Fed use, and DAMN sure Sessions isn’t sending in the boys to round up the lawbreakers...

We all know how much we’ve turned into a Banana Republic.

The city treasurer should go running into the mayor’s office yelling “ They didn’t make the deposit. We didn’t get the money. We can’t meet the payroll!!”
