Yes there are two sides, but one side has been proven over the years to be extremely unsavory, and worthy of discontinuance. This isn’t something Sessions should be pushing.

I got some flak last week for saying it is time to reconsider our support for Sessions and this serves to reinforce the validity of that position. There have been too many abuses of this policy.

I approve of civil asset forfeiture, but only when there is a felony conviction based on proof beyond a reasonable doubt. In that case, if the preponderance of evidence shows a link between the felony conduct and the asset, I’m okay with forfeiture. Otherwise, no.

Many cases have proven over the last few decades that the amount of power this gives law enforcement turns too many of them into “Legalized Highway Bandits”.

It is a shortcut around due process and as such has been abused too damned much. Stories of citizens being pulled over for a minor traffic offense having thousands of dollars in cash STOLEN from them because they were practicing their right to freely associate their money...

Property being seized and after an innocent verdict the property just going “POOF” like it wasn’t even there.

It is a horrible law that encourages “Boss Hoggery” at the local level and cartel behavior at a federal level.

It is just as bad as when the IRS seizes property without a trial or charge.

There is a lot of stuff the the Government does now that is UN-Constitutional. Social Security, Food Stamps, mandating you buy stuff, etc. This is just one of those things. Indications are that AG Sessions is going to go after the assets of actual criminals, instead of confiscating Sub Shop owner’s income because they happen to make just under $10K a week. He is going after human-traffickers in a big way, and this could help confiscate their assets and really shut things down.

I agree, there should be PENDING FELONY DRUG CHARGES AND A SEARCH WARRANT AND AN ORDER BY A JUDGE TO SEIZE ASSETS BEFORE SUCH THINGS ARE DONE.

and then the items should be impounded pending outcome of a trial and returned if there is a not-guilty verdict.

This crap about seizing property on a whim in the field is just abusive crap.

A citizen’s assets should never be seized by government until they have been proven guilty of a crime in a court of law by a jury of their peers! Anything else is government tyranny. And yes, I don’t care if it’s “for the children” or necessary to stop “drug cartels”.

When I read the details on this, it didn't appear to be an expansion really. Instead it expands the Federal government's powers to take confiscated property from local police departments who have already taken it.

In theory, that could remove some of the incentive for local police departments to seize things from people.
