Judicial Watch: Obama NSC Advisor Susan Rice’s Unmasking Material is at Obama Library

(Washington, DC) – Judicial Watch today announced that the National Security Council (NSC) on May 23, 2017, informed it by letter that the materials regarding the unmasking by Obama National Security Advisor Susan Rice of “the identities of any U.S. citizens associated with the Trump presidential campaign or transition team” have been removed to the Obama Library.

The NSC will not fulfill an April 4 Judicial Watch request for records regarding information relating to people “who were identified pursuant to intelligence collection activities.”

The agency also informed Judicial Watch that it would not turn over communications with any Intelligence Community member or agency concerning the alleged Russian involvement in the 2016 presidential election; the hacking of DNC computers; or the suspected communications between Russia and Trump campaign/transition officials. Specifically, the NSC told Judicial Watch:

Documents from the Obama administration have been transferred to the Barack Obama Presidential Library. You may send your request to the Obama Library. However, you should be aware that under the Presidential Records Act, Presidential records remain closed to the public for five years after an administration has left office.

Presidential Records Act (PRA) of 1978
The PRA also establishes procedures for Congress, courts, and subsequent Administrations to obtain special access to records that remain closed to the public, following a thirty-day notice period to the former and current Presidents..

Presidential Records (44 U.S.C. Chapter 22)
§ 2202. Ownership of Presidential records
The United States shall reserve and retain complete ownership, possession, and control of Presidential records; and such records shall be administered in accordance with the provisions of this chapter.

§ 2205. Exceptions to restricted access
Notwithstanding any restrictions on access imposed pursuant to sections 2204 and 2208--

(2) subject to any rights, defenses, or privileges which the United States or any agency or person may invoke, Presidential records shall be made available-- (A) pursuant to subpoena or other judicial process issued by a court of competent jurisdiction for the purposes of any civil or criminal investigation or proceeding;
(B) to an incumbent President if such records contain information that is needed for the conduct of current business of the incumbent President’s office and that is not otherwise available; and
(C) to either House of Congress, or, to the extent of matter within its jurisdiction, to any committee or subcommittee thereof if such records contain information that is needed for the conduct of its business and that is not otherwise available; and

...ANY of these records can be subpoenaed.

Actually, they don't need a subpoena at all.

Neither (2)(B) nor (2)(C) make mention of a subpoena.

...not otherwise available...

No copies? No problem.
Or is he going to say 'no' to a Senate committee or subcommittee request?

This May 27, 2017, notice from the NSC was in response to the Judicial Watch request dated Aril 4, 2017. This was Trump’s NSC.

Also, the Obama Library does not physically exist yet. It has not been built yet.

So where are these documents and who is holding them?

The deadline was April 4. The begin date was in January before the inauguration. We don not know when the documents were moved or by who.

The NSC dated its response May 27, 2017. That was the Trump NSC.
