The new law attempts to preserve history by making it illegal to remove monuments that have been in place for more than 40 years.

The Alabama Memorial Preservation Act of 2017, signed into law Wednesday by Alabama Gov. Kay Ivey (R), protects historical Confederate monuments which have come under fire in recent weeks by Democratic politicians.

The new legislation prohibits:

The relocation, removal, alteration, renaming, or other disturbance of any architecturally significant building, memorial building, memorial street, or monument located on public property which has been in place for 40 or more years.

What city council has jurisdiction over the Confederate Memorial Monument at the Alabama State Capitol?

I’m not talking about the capitol, but rather monuments that are owned by local governments.

Do you believe that local governments and private organizations should have the right to manage their own property as they see fit?

I guess I should have made it clear...I wouldn't *support* such a move. All I was saying is that the left will stop at nothing to achieve their goals.

“Can a state government mandate to cities what monuments they have to maintain on city property?”

Beats me,I’m no lawyer but when states enact laws, like no smoking, cities have to prohibit it.

After what the courts did to Trump and immigration I’m bewildered.

.

I have two great-great-great uncles who were from Alabama who fought at Vicksburg and were part of the enormous number of dead for which there is no gravestone.

Those monuments mean something to the families of all those young men who bravely fought on the battlefield.

The left’s desire to remove Confederate monuments stop with the entity that owns the monument.

But you would agree that the people of Tuscaloosa could remove a Confederate monument that they own and the State of Alabama has not power to stop it?

Alabama and Tennessee have this.

It passed in Virginia too, but was vetoed by McAwful. Hopefully Ed Gillespie will sign it after he wins this year.

It was going to pass in Louisiana too, but the Senate President sabotaged it. No joke. A bill was filed that was similar to this one passed by Alabama, designed to stop the tear down in New Orleans. It had the support of most in the state legislature, but the State Senate President purposefully assigned it to the wrong committee, a committee that was majority black Democrats, when its correct committee was majority white Republican. He knew it would pass, and did that underhand thing to stop it.

How does the state argue in court that it was the right to prevent Montgomery, Alabama from removing a momunmet that they own?

On the other hand, does the federal government have the power to force Atlanta, Georgia to errect a Gen. Sherman statue?

The Tennessee does this is any historical monument has to be approved by the legislative historical review commission

Not likely to go stupid like a metro black area will

Thankfully

It’s pitiful to see the usual south haters here allying with Landreiu et al

Same old shite I’ve watched here for nearly two decades

I see stuff here get race bait posted here and it’s fast from south haters

And the most recent news link is the SPLC

you think that’s coincidence

I sure as hell don’t

The state's going to win in court, no matter how much you don't like it. Courts have established their power over cities time and time again.

They're not forcing anyone to erect a statue, but rather to leave them alone if they've been there over 40 years. The federal government does the same stuff with landmarks and national parks.

Lord knows, but states force cities and town to do lots of things and I just don’t get it.

The 40B law here in MA,regarding affordable housing, has made many towns miserable. The state doesn’t give a damn.

The Alabama law, from what I have read about it, attempts to control property the is owned by a local government.

Fort Sumter was U.S. federal property.

Just like Fort Washington was British Property prior to July 4, 1776. After July 4, 1776, it was American property.

Ed Gillespie will not sign it. Nor will he cooperate with immigration enforcement. That’s why I will not be voting for him in the primary or general election.
