House GOP to File Criminal Charges Against Lois Lerner in IRS Scandal

Rep. Peter Roskam (R-IL) went on with Stewart Varney on Thursday morning to discuss recent developments on Capitol Hill.
 
Roskam told Stewart House Republicans are planning of filing criminal charges against Lois Lerner.
 
 
Rep. Roskam: The Obama Administration was very lenient with the crimes that Lois Lerner committed. And those are strong words that I’m using but the House Ways and Means Committee voted out a criminal referral to the Department of Justice which was completely dismissed by the Department of Justice… We think that Lois Lerner did two things wrong. Number one, she denied people due process and equal protection of the law based on their political philosophy. We’re convinced that there is overwhelming evidence to suggest that that’s true. And that’s a felony. Secondly, we suspect that she lied to the Inspecter General of the Treasury Department.

These Congressional hearings are for our pleasure, as you seen with Gowdy and a few others...

Unless and until there are Grand Juries called to hear these charges, nothing is going to change...

We, the American People, that have been stomped on, abused and robbed every minute of every day for years deserve these people to see the inside of a prison cell or better yet a good old ‘Town Square hanging until the birds clean the flesh off their bones’!!!

That would be correct, it is not a criminal filing. I wonder which office gets that? The USA in DC or the Public Integrity unit in DOJ.

If they waited a few more months, the statute of limitation would have expired too, which it may anyway.

PRISON and lots of it. She knew it was wrong from the start.

Maybe she will give up the higher-ups who ordered it if she's is facing 20 to 30 years...

I wonder if a federal retiree is convicted of committing a crime while working, it they lose their federal pension.

I don't know but I hope so, but not until they are convicted. Also, probably the judge has some leeway in the matter.

Are you of the impression libertarians don’t believe crime committed by politicians should be punished?

I am of the impression that there are prosecutors and courts, that there are constitutional prohibitions against bills of attainder and ex post facto laws, both of which indicate that Congress has no business investigating, charging, trying, or punishing crimes.

Nothing would make me more happy than to see a truck-load of high-level Demoncraps go to jail..... but I won't hold my breath. Demoncraps regularly lie to Congress, perjure themselves, show contempt - with impunity!! Our beloved Republican Congress has perfected expressing outrage through Kabuki theater aka congressional hearings - and that's about all they do.

Judge Andrew Napolitano was on the Stuart Varney show on Fox Business channel this morning. He stated that the Justice Dept. would not open a case against her simply because the Obama Justice Dept. closed its investigation without taking any action against her. Napolitano said the Justice Dept. has a long tradition of not re-opening cases that were closed by Justice under a prior administration unless new evidence has been uncovered.

Correct, Sort of. Congress Can NOT File Criminal Charges, but they have ABSOLUTE UNQUESTIONABLE AUTHORITY to LOCK YOU UP for Refusing to answer their questions or answering them in a way they don’t like.

it is called Inherent Contempt and CONGRESS used to use it quite frequently to get to the bottom of things. This was back when we still had Americans as Elected Officials.

I highly recommend EVERYONE look up the Hinds Precedents,(Google) it is a Photocopy of the records, so a little hard to read, but WELL worth it!!!

Congress has ALL the power in washington, the executive and judicial branch operate according to the whims of CONGRESS!

TITLE 2—THE CONGRESS
CHAPTER 6—CONGRESSIONAL AND COMMITTEE PROCEDURE; INVESTIGATIONS
Sec. 193. Privilege of witnesses
No witness is privileged to refuse to testify to any fact, or to produce any paper, respecting which he shall be examined by either House of Congress, or by any joint committee established by a joint or concurrent resolution of the two Houses of Congress, or by any committee of either House, upon the ground that his testimony to such fact or his production of such paper may tend to disgrace him or otherwise render him infamous.”

Simply look up Hinds Precedents, especially chapters 53 and 51, and Cannon’s Precedents, especially chapters 184-185. You’ll find numerous detailed cases of Congress asserting its power, arresting people, holding them until they agreed to answer questions, and then releasing them. Some of these people did not refuse to appear, but simply failed to satisfactorily answer questions. One has to wonder how a previous Congress might have responded to Alberto Gonzales’s endless recitations of “I do not recall.”

Congress can Remove the President
Congress can remove the head of every executive agency Congress can remove ALL of their employees
Congress can Abolish every agency they so choose
Congress can remove EVERY JUDGE IN AMERICA, including every supreme court justice.
Congress can abolish every federal court except the supreme Court
Congress can decide which cases the Judicial Branch can hear and decide
CONGRESS can Imprison ANYONE they want for any reason they so desire for as long as they wish.
Congress can declare WAR

No other governing body has even 10% of the power CONGRESS has!!

CONGRESS IS ALLOWING ALL OF IT!!!

Congress has the authority to arrest and imprison those found in Contempt. The power extends throughout the United States and is an inherent power (does not depend upon legislated act)

If found in Contempt the person can be arrested under a warrant of the Speaker of the House of Representatives or President of the Senate, by the respective Sergeant at Arms.

Statutory criminal contempt is an alternative to inherent contempt.

Under the inherent contempt power Congress may imprison a person for a specific period of time or an indefinite period of time, except a person imprisoned by the House of Representatives may not be imprisoned beyond adjournment of a session of Congress.

Imprisonment may be coercive or punitive.

In 1857, a New York Times reporter refused to say which members of Congress had asked him to get them bribes (protecting his “sources” just as various Judith Millers today protect the people who feed them proven lies that costs thousands of lives), so Congress locked him up until he answered and then banned him from Congress.

In 1924 an oil executive appeared but refused to answer certain questions, so the Senate held — literally held — him in contempt. Senator Thomas Walsh of Montana argued that this question of contempt was of the gravest importance, and that it involved “the very life of the effective existence of the House of Representatives of the United States and of the Senate of the United States.” The matter was taken to court, and the witness fined and imprisoned.

Present all the evidence in a federal court of law and then let her use the 5th amendment and see how that works out .

It’s time to go after Fast , the black panthers in Philly and other fed. crimes committed during the past admin .
