Felony charges for 2 who secretly filmed Planned Parenthood

LOS ANGELES (AP) -- California prosecutors on Tuesday charged two anti-abortion activists who made undercover videos of themselves trying to buy fetal tissue from Planned Parenthood with 15 felonies, saying they invaded the privacy of medical providers by filming without consent.

The charges against David Daleiden and Sandra Merritt of the Center for Medical Progress come eight months after similar charges were dropped in Texas.

State Attorney General Xavier Becerra, a longtime Congressional Democrat who took over the investigation in January, said in a statement that the state "will not tolerate the criminal recording of conversations."

Exactly where did this filming take place? If it wasn’t in California, there is no prosecutable crime in California and this is prosecutorial misconduct.

OK, it was the TEXAS prosecutors who were out of line. . . but so are the California prosecutors, constructing a crime for which they are claiming a felony. This was not a medical practitioner, nor was it violating any patient’s privacy rights under HIPAA regulations. No names or specifics were exchanged. It was a journalist documenting a crime.

I don’t think Sessions could intervene in this case because they are being tried in a State Court. However, if Sessions believed that David Daleiden and Sandra Merritt are being prosecuted wrongfully there might be a Federal case for their civil rights being violated under color of authority. Maybe someone who knows the law can give an opinion.

As well he should. Californians voted in 2016 both against a repeal of the death penalty, and in support of expediting its use.

Should tell you something about the death penalty's support when even California, with the liberal turnout it had in 2016 (the only state where Clinton did better than Obama in 2012) still supports it.

He can't. Presidential pardons are for federal crimes only; this is a state crime being prosecuted by California.

I would suppose the line of lawyers to defend these two is not just around the block but into the next county over, talk about juicy career builders that is nearly guaranteed to go before SCOTUS and might even be the case that breaks the shield of public officials not being held personally financially accountable for their actions.

I’m also sure that the 9th has already written their denial of the appeal (just waiting for a few details to put the final touches on from the trial and conviction.)

Heck, it might even be the case that busts the ‘privacy right’ that was so graciously discovered in Roe v Wade.
