It Could Be Close: Counting To 51 On The Nuclear Option

Senate Minority Leader Chuck Schumer’s vow to lead a filibuster of Judge Neil Gorsuch’s nomination to the Supreme Court raises the prospect of a dramatic rules-change that would permanently alter the Supreme Court confirmation process.

The question now is whether there are 51 votes in the Senate Republican caucus to support the nuclear option. While most Republicans seem prepared to back the measure, a handful of consensus-oriented veterans may be recalcitrant to change the rules and further escalate the judicial confirmation wars.

The Senate will give him the votes. This is Schumer’s way of demanding that Ginsburg will be replaced by a rat judge to keep the status quo.

False and a fantasy; Sen. Mitch McConnell is cooperating with President Trump and moving the nomination along. If necessary, and if Sen. Schumer is so foolish, he will invoke a nuclear option and Neil Gorsuch will be confirmed despite the machinations of some conservatives, including those on FR trying to derail the Gorsuch nomination because they imagine he is not conservative enough. There is so much fantasy on FR.

Gorsuch is dead in the water. I was thinking that a deal would be reached to allow his nomination to pass in return for a pledge from 3-4 RINO Senators ( we know who they are)to keep the current 60 vote rule on the next nominee. But the Democrats don’t need to make any deal because those 3 or 4 RINOs like McCain who will sell out for peanuts.

Maybe somebody can explain the “nuclear option” to me. What do they mean when they say that it can only be used once?

I’m not so sure Gorsuch is the conservative we think he is. It was posted (after this post on FR) that Gorsuch goes to a liberal church with a woman minister that supports gay rights. Troubling.

The reason Garland isn't on the court is because people like you and me have been donating and calling and voting and dragging out other voters to give the country a Republican Senate, House and now the White House.

If there has been a clear message in the past few elections it was---no, not Obamacare---but the need to put the reins on the increasingly radically Left U.S. Supreme Court.

Yes, I am glad McConnell held the seat open. But WE put him position to do it, and we worked to give him a President who will follow through.

McConnell had damned little choice. If he had allowed that seat to be filled before the election---there would have been a Hillary landslide.

Now McConnell is safe for, what, another four years? We'll just see how he handles Gorsuch.

What were you watching election night ?

It was supposed to be a Hillary electoral landslide with the Senate gone too. She was going to appoint, and have the new Senate confirm, a ninth justice more liberal than Garland. Sen. McConnell was a hero for blocking his consideration as other Republican Senators wavered in the face of Donald Trump's storming the party and winning the nomination.

The American people are the Swamp. They have been completely corrupted by OPM (Other People’s Money). The Swamp cannot be drained until the American people refuse to take OPM.

During the Great Depression, millions of Americans refused public assistance, returning their direct assistance checks with angry letters, denouncing the government for questioning their ability to survive without public charity. My how times have changed.

I think perhaps what they are saying is that it only needs to be used once. The "nuclear option" would permanently change Senate rules (until a new rule might be adopted) so that a Supreme Court justice cannot be filibustered. This would mean that a confirmation vote would take place and a simple majority would dictate whether the nominee is confirmed or not.

The Demoncrats already invoked the nuclear option for all other Presidential nominees. It's my understanding that the only nominations subject to filibuster now are those for the Supreme Court.

We need to quit calling these republican liars gutless. They are not afraid.

It gives them a crutch and is misleading. They know exactly what they are doing they are there for themselves and will sell the souls of their children to make themselves rich.

I did not say their own souls for they went to the highest bidder long ago.

Linda Graham already said that he/she supports Gorsuch. Also Pence could be the tie breaking vote.
