A Roadblock to the Court for Neil Gorsuch

Senate Republicans had to know there would be a price for their unprecedented theft of President Barack Obama’s final Supreme Court pick last year.

On Thursday, Chuck Schumer, the Senate minority leader, named it: Either find 60 votes to overcome a filibuster of President Trump’s extremely conservative nominee, Judge Neil Gorsuch, or find another, more moderate choice.

The last four Supreme Court nominees — two from Mr. Obama and two from President George W. Bush — all met the 60-vote threshold, Mr. Schumer said, so it was fair to require the same of Judge Gorsuch.

I don’t remember a similar editorial when Reid nuked the lower court filibuster. At the time, when the Republicans threatened to filibuster DC Circuit judges, the MSM claimed that Reid had to nuke the filibuster due to “the most recent examples of what Democrats have long considered unreasonably partisan obstruction by Republicans.”

Stopped right there. The entire premise of the article is a lie based on the opening statement. They will repeat this lie until it becomes accepted as the truth unless we call them out every time.

Please identify the constitutional provision requiring 60 votes. I am well familiar with Article I, Section 5 “Each House may determine the rules of its proceedings...” but not familiar with the qualifier “as the NYT may direct.”

If I were in McConnell’s shoes I would pass a Senate rule that says any Senator who voted to confirm Gorsuch to his current appellate court seat will be counted as a “Yes” vote in this confirmation process. He was confirmed unanimously to that post, so that should get him way over 60 votes this time around.

Schumer is on his last leg. I'm not sure his entire party wants to follow his lead.

Gilibrand has already said she would vote for Gorsuch. He's on the way out and Gillibrand is on the way up.

Betting the party will follow her lead and he'll pass handily with an up and down vote.
