Dems may be ready to deal on Gorsuch

Democrats may be ready to throw in the towel in opposing the nomination of Neil Gorsuch to be associate justice of the Supreme Court.  According to Politico, several sources are reporting that a group of Democrat senators may be willing to allow the Gorsuch confirmation to go through on the Senate floor in exchange for a pledge from Republicans not to get rid of the filibuster.  Their thinking is that if President Trump has another opportunity to name a Supreme Court justice, they want the option of blocking any nominee.

Another vacancy would be far more consequential, as it would determine the balance of power between liberals and conservatives on the court.

If Democrats move ahead with the plan – it's still in the early discussion phase – it would require buy-in from some Republicans, but not necessarily Majority Leader Mitch McConnell (R-Ky.) or his top deputies. At least three rank-and-file GOP members would have to pledge not to vote to unilaterally change the Senate rules through a majority-only vote later in Trump's term – the so-called nuclear option.

Cobbling together a group of senators from opposing parties to take such a stand would be difficult, given the long-running partisan war over confirming judges and pressure from the left to deny Gorsuch confirmation. But some Democrats are worried enough about the Senate losing its unique minority rights that they've begun kicking the tires on the potential for a new bipartisan "gang."

The current talks are limited to about a half-dozen Democratic lawmakers. They haven't made an offer to Republicans yet, and Democratic leaders wouldn't support one.

Democrats familiar with the effort requested anonymity to discuss a sensitive matter that divides the caucus.

The DEAL means NADA.

It requires Amending the Constitution instead which won’t happen. Take the fake deal then ignore next fillibuster.

Not only is caving a bad idea, but a half-dozen Demoncrats won't cut it, it would take 8.

I say force the Dems to filibuster, then get the 10 who are up for re-election in states President Trump one to go on record as supporting the filibuster. Then pull the nuclear trigger. Then hammer them over this vote for two years, until the next election.

Republicans would be crazy to give such a pledge - therefore they will probably do it.

Rs are in the driver’s seat and should make clear to the ‘rats that Gorsuch is going to be confirmed one way or the OTHER. If it requires nuking the dirty ‘rats then so be it.

Alas, with weasels like McConnell, McVain, Graham, Flake, and Collins it is unlikely that the Republicans will play hardball as they should. They will probably make all sorts of concessions and deals to try to get the ‘rats to stop blocking on Gorsuch, who should have been confirmed by now.

That's assuming Gorsuch turns out to be a conservative. I think he will be another Sandra Day O'Connor. The result of that would be 3 conservatives (one of which turned traitor on Obamacare), 2 wobblers (Kennedy, Gorsuch) and 4 radical socialists.

I wish I could say you're wrong, but my gut feeling for weeks has been that you're right. I give it about an 85% chance of happening at this point.

It looks like the Dem filibuster will go nowhere, Gorsuch will be confirmed by a similar margin that Souter and Roberts were (every Republican Senator blindly rubber stamping Gorsuch because he says he is an "originalist" who will "strictly follow what is written in the constitution" and his fan club lives in some alternate reality where that strategy worked awesomely in the past instead of being a proven failure). About a dozen or more RAT Senators who couldn't find any dirt on Gorsuch will instinctly vote "no" him because he has an R next to his name. Gorsuch will get in and once he has a cushy job for life, will become a right-of-center squish who does some decent things but easily caves to the four commies from time to time. It will be a huge downgrade from Scalia and move the court to the left to have a Sandra Day O'Connor type judge in a formerly rock solidly conservative seat.

When it comes to replacing a true marxist like Ruth Bader Ginsburg, Trump won't have nearly the advantage he does now to name a conservative, and will be forced to name some colorless centrist to win a Senate confirmation vote, and the result will be another John Paul Stevens type judge who starts off semi-decent but "evolves" in office and becomes increasingly leftist over the next decade.

The end result will be a Supreme Court that is far more liberal than the one Trump inherited when he entered office, though I don't expect the FReepers who screamed this election is about the "Supreme Court" and swore up and down that Trump would appoint nominees to the right of Reagan's bench (and demonized those of us who didn't believe it during the 2016 primaries) will ever admit they were wrong.

In this case, I'm praying *I'm* wrong.
