Trump could 'do an Andrew Jackson' to save travel ban

The Trump administration Friday afternoon filed for an appeal of a Maryland federal judge’s ruling that the revised ban violates the First Amendment by disfavoring a particular religion. The case goes to the U.S. Court of Appeals for the 4th Circuit in Richmond, Virginia.

But a federal judge in Boston approved the original order, noted attorney Robert Barnes in an interview with XM Sirius radio’s Breitbart Daily News

Agreed. There are too many knee-jerk responses on these threads. If Trump were to ignore the judge (and I agree the judge is 100% wrong), you would have a loud chorus of Dems and many RINOs like Linda and McStain screaming for impeachment. And does anyone believe that Eddie Munster up there leading Congress has Trump’s back?

I’ve always thought that the answer to this question is to just outright restrict all immigration in it’s entirety for 100%. Then Trump speaks to the American people, reiterates the statute and says that if the judges are going to pick apart an EO on political correctness, then we will restrict all immigration so that everyone is treated equally.

This is impeachment bait.

Remember, both the GOP Establishment and the Dems are lying in wait for an impeachment opportunity.

The GOP Establishment would be thrilled with Pence as president, we would be back to global free trade agreements and importing cheap foreign labor.

Trump needs to get his guy on the Supreme Court and then let the Supreme Court overturn the lower court judges.

I agree. When the judicial branch is able to illegally and unconstitutionally push the executive branch around then our republic is doomed. I’ve long advocated for the executive branch to ignore the judicial branch when it oversteps its boundaries. The legislative branch can intervene if it feels necessary to do so. The current situation is absolutely ridiculous and the courts need to be smacked down.

I am no expert but I thought to apply for a visa you had to have an in-person interview with a consular official. At this point, I would just make 1 appointment per day available. Just slow down the process while appealing the decision.

I’m deeply disappointd with Trump on this issue. He’s letting lower court judges run all over him when it is well within his authority to ignore their rulings and enforce his ban until the Supreme Court makes a ruling.

Me too! I just not disappointed I am discussed. Punk judges will violate law and make most of Trumps EO nullified and it will stick unless these judges are impeached. And the weak lazy Republicans would never start the impeachment.

If judges can make rediculously illegal and incoherent decisions with impunity, then eventual impeachment is a given irrespective of anyone taking any “impeachment bait”. If the Law is powerless to stop the former then it cannot stop the latter. Simply spontaneously impeaching the president would be no more or less idiotic than what has been done already.

These federal district courts are overstepping their authority and `flipping off’ a coequal branch.
Tell the men in gowns, “Thanks for the opinion. I’m doing my job now.”
Or don’t tell them anything and just start sending our memos ordering action. Don’t want to do your job? Send in your resignation.
When does he start firing people?

LOL! Though IMO he resembles Bashar Assad who could do a better job than Ryan, being an M.D. who speaks flawless English and knows the stakes.

ok people, this freedom of association thing is being used by the left to justify unlimited immigration. Citizenship is not transferrable. A naturalized person does not have the right to bring his entire village over. Nor does that person have the right to expedite bringing adult children and their extended families who are fully capable of applying on their own.

Remember the credo of the 70's liberals? Use the system to break the system? We cannot allow precidents to be set that other nationalities can then legally mimic. We must return to pre-1965 quotas and preferences if we're going to save the identity of this country and protect it from wholesale "legal" invasion. And we need to do that now, snowflakes be damned.

The constitution doesn’t say the President has authority but only if every single federal judge says so.

Screw the judges. They are not the executive.

Let’s start with the Constitution, which vests all executive power in the president. Under the Constitution, as Thomas Jefferson wrote shortly after its adoption, “the transaction of business with foreign nations is Executive altogether. It belongs then to the head of that department, except as to such portions of it as are specifically submitted to the Senate. Exceptions are to be construed strictly.”

The rare exceptions Jefferson had in mind, obviously, were such matters as the approval of treaties, which Article II expressly vests in the Senate. There are also other textual bases for a congressional role in foreign affairs, such as Congress’s power over international commerce, to declare war, and to establish the qualifications for the naturalization of citizens. That said, when Congress legislates in this realm, it must do so mindful of what the Supreme Court, in United States v. Curtiss-Wright (1936), famously described as “the very delicate, plenary and exclusive power of the President as the sole organ of the federal government in the field of international relations – a power which does not require as a basis for its exercise an act of Congress.”
