Arizona Senate votes to seize assets of those who plan, participate in protests that turn violent

Claiming people are being paid to riot, Republican state senators voted Wednesday to give police new power to arrest anyone who is involved in a peaceful demonstration that may turn bad — even before anything actually happened.

SB1142 expands the state’s racketeering laws, now aimed at organized crime, to also include rioting. And it redefines what constitutes rioting to include actions that result in damage to the property of others.

But the real heart of the legislation is what Democrats say is the guilt by association — and giving the government the right to criminally prosecute and seize the assets of everyone who planned a protest and everyone who participated. And what’s worse, said Sen. Steve Farley, D-Tucson, is that the person who may have broken a window, triggering the claim there was a riot, might actually not be a member of the group but someone from the other side. ---------------------------------------

But Sen. John Kavanagh, R-Fountain Hills, said that chilling effect is aimed at a very specific group of protesters. “You now have a situation where you have full-time, almost professional agent-provocateurs that attempt to create public disorder,’’ he said. “A lot of them are ideologues, some of them are anarchists,’’ Kavanagh continued. “But this stuff is all planned.’’ -------------------------------------

There’s something else: By including rioting in racketeering laws, it actually permits police to arrest those who are planning events. And Kavanagh, a former police officer, said if there are organized groups, “I should certainly hope that our law enforcement people have some undercover people there.’’

Agree but would thumbs up a civil fine for breaking the law that has caused damage ..... Which laws already exist.. Why do lawmakers have to invent something new rather than enforcing existing laws ?

I plan protests and this law will never pass first amendment muster. Really does have chilling effects.

The Federal Courts, aside from SCOTUS, are creatures of Congress, not the COnstitution. Congress established them and Congress can eliminate them. And eliminate them they should. That would require SCOTUS to handle ALL Federal cases and SCOTUS would then be EXTREMELY judicious with respect to what cases they pick. In effect, eliminating the appeals and district and circuit courts, more state power would accrue to the states, limiting Federal Interference. People could then vote with their feet and leave states whose policies conflict with their beliefs and head for those where the policies are more in line with their thinking.

Obama, Congress and Courts have already set precedent by approving the 2012 NDAA which permits Gov’t to arrest and Indefinitely detain citizens accused of demonstrating belligerence toward gov’t.

WITHOUT due process.

This latest proposed asset forfeiture is merely the icing on the cake.

When future Mega Economy Crisis hits, gov’t will disappear dissidents and absorb their wealth, ala 1984.

As for our two party / Uniparty lawmaker’s stewardship, regard for we the people and tell US Constitution -

Assert forfeiture is unlawful, via simple reading of USConstitution. If you allow it to be created because it will be used against evil, it is still wrong, not allowed, unless you amend USConstitution.

I am completely against anyone, any party, any group that seeks to or supports violating the supreme law of USA, the Constitution.

Sorry, but I have to side with the dems on this one. If we allow the govt. to confiscate their property (hooray for our side!), eventually they will be cheering when it's time to take our property based on the whims of some black robed devil.

I MIGHT reconsider my position if the proposed law were tweaked so that the proceeds do NOT end up in government hands. Better it be thrown into a pit and burned then allow the govt. to profit from their "order keeping".

On second thought, not even then. Bad idea. Reduce, don't expand govt power.

You must be talking about a false flag operation where leftists infiltrate our crowds and try to blame their mayhem on us. It’s not easy. Most of our events are by permit. Leftist agitators don’t last long as they show their true colors early. Find out who has the permit. This person will bring the jerk to attention of law enforcement who will gladly escort them away. That’s what I’ve seen happen.

Leftists would also try to hide in the crowd while committing their violent acts. We give the no cover.

I like how it starts the discussion.
The end result should be that the assets of those who organize and pay protesters should be held and they should also be held liable for violence and property damage, even paying police in such cases that turn bad.

The proposed legislation would appear to be a direct violation of the first amendment.
The perpetrators of violence and anyone engaging in incitement of violence should be caught and prosecuted but to attempt to extend that to anyone who organizes or participates in a protest that they reasonably expect to be peaceful will never stand up to judicial scrutiny.
Amendment I

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances
