President Trump and the Runaway Judiciary: The Founders Have Provided the Remedy

Recently, a rogue U.S. District Court Judge issued and a panel of the Ninth Circuit Court of Appeals affirmed one of the most egregious judicial decisions in American history, dramatically undermining and thus relegating the issue of the sovereignty of this nation to the courts and unelected judges. This was the culmination of decades of ever expanding judicial activism enabled by the failure of Congress to enforce its prerogatives and rein in this runaway usurper of political power. The matter of the supremacy and influence of the judiciary in a representative republic has been an issue of contention since this nation’s inception, as the founders, while geniuses in their overall concept of government, erred greatly in the creation of an unaccountable Judiciary by relying on a factious Congress to serve as a check and balance on a co-equal branch when necessary.

A major issue of debate during the Constitution ratification process in 1788 was the structure, power and control of the Judiciary. The issue was twofold: 1) the degree of independence and the level of accountability of federal judges; and 2) Judicial Review of laws and statutes passed by Congress.

The Trump administration can do what the Jackson administration did. Simply ignore them. Jackson challenged them to enforce their ruling.

Jackson didn't have Civil Service regulations. Jackson could fire any person in the executive branch who refused to follow Jackson's orders.

The judge's order gives cover to Obama sympathizers in the executive branch to give the finger to Trump.

Given how much power the courts have usurped, we’ve had a constitutional crisis for quite a while, and the courts are in serious need of a 2x4 upside the head.

Trump should take this as a golden opportunity to do just that, given how egregious this ruling is.

You mean like send an armed contingent of Marines to the court tomorrow to escort the justices involved, and the AG and governor of WA, to Gitmo to await trial for obstruction of an officer in discharging his national security duties (Trump).

He would not be acting like a king. The law specifically gives him that power. That is the point he should be driving home.

The one that is acting like a despot is the court, who is arbitrarily overruling the law passed by Congress. In other words 4 unelected judges are overruling two branches of government. The law is absolutely crystal clear that President has the legal authority to do what he did.

And as a remedy to the judges overstepping their bounds the president can simply ignore them. He just better make sure he has his ducks lined up before he does.

My hope is the traitors in congress are afraid of what the Trump supporters might do if they impeach Trump. Again, my HOPE.

My other hope is that us Trump supporters WILL do something if they try to overturn the election.

I highly recommend all the free on-line courses offered by Hillsdale College but the first lecture of the U.S. Supreme Court course provides an excellent history of Judicial Review.
