Ninth Circuit Court Now Demands It Be Protected From Itself…

Oh, the winning… it’s often too funny. The Ninth Circuit Court of Appeals is now independently, on its own impetus, requesting an internal vote on a full panel en blanc hearing to review its own decision.

Additionally, the full ninth are asking the Trump administration to file an additional brief telling the court why the three member original appeals ruling authority was wrong. In essence, the smart judges know what wasn’t considered, and are now looking for an out.

You just can’t make this stuff up.

The 9th has done the stupidest thing possible for Judges in our legal system by embroiling themselves in politics and offering a politically correct but bluntly illegal and unconstitutional ruling.

what is disgusting is the local new channel this morning talking about how "this is an example of the system working... it's call part of checks and balances... the Executive Branch doesn't have all the power"... then they went on to say that Trump is used to having better lawyers than the people he fights in court, but that's not the case now that he is President. SERIOUSLY??? do they really not know better??? do they really not know that this Circuit always over-steps? do they really not know that what they did was NOT Constitutional???!!! i am disgusted with the court and with the media...

Yes, that’s what I’m thinking. They are being entirely political - they want to be able to rule against the President again and create another round of negative news stories.

He should revoke the EO and reissue.

A legal principle is that the judge must take judicial notice of the law.

The law is presumed to be referenced in all pleadings. Those arguing a case do not have to separately advise the judge of the provisions of the law.

I don’t think trump saw that coming that is it would be stopped at the appellate level too. Never bet on a court verdict.

The truth is they are concerned that the Legislative and Executive branches are darn well fed up with them and are afraid they are set to be eliminated.

It is highly unusual. The have been listening to legal scholars for the last few days saying it is totally in the President wheelhouse and one of them finally got up, blew the dust off a law book, and figured out they were scre#ed.

The entire country is laughing at them

Back in the 80s I had a friend that worked at a movie theater and we saved all the leftover popcorn for about a week and just about filled the back of his pickup with it, then piled in a bunch of guys (it was legal back then) and cruised around Huntington Beach attracting birds and annoying other drivers and generally being silly.

Good times, until a bird got run over on Pacific Coast highway in full view of a cop who told us to secure the popcorn or face a ticket.

According to Judge Andrew Napolitano, the Constitution says the Judiciary branch has no authority to over ride a Presidential Proclamation that is in itself legal.

There is no way they can save themselves now...they took on the wrong person...

Thinking that President Trump was going to be another ‘Republican President that hides in the closet’...they just found out they are done for...

IIRC, the full appellate court must review a panel ruling before a case can go to SCOTUS. Some of the cases on 2nd Amendment issues that have been followed closely here in the past have gone through this process.

That might be because anyone who can read has very little problem comprehending the phrase “Whenever the President shall determine...”. That one seems to have confused the 9th Circuit judges.

Is this a trap? Might be.

Am I wrong to assume that if the full 9th hears the case on merits AND Trump wins, the State of Washington could then appeal to the USSC where we assume it would be 4-4 but perhaps not?

There is no reason to consider an en banc session, which would allow the 9th circuit to jigger the embarrassing and extra-legal 3 'judge' panel's foolish and so obviously politically motivated decision.
