Oh, the winning… it’s often too funny. The Ninth Circuit Court of Appeals is now independently, on its own impetus, requesting an internal vote on a full panel en blanc hearing to review its own decision.
Additionally, the full ninth are asking the Trump administration to file an additional brief telling the court why the three member original appeals ruling authority was wrong. In essence, the smart judges know what wasn’t considered, and are now looking for an out.
You just can’t make this stuff up.

I’ve told my liberal friends who have been gloating some ref this case to understand Trump is now positioned In a very public way as fighting in court to protect people. Who in their right mind wants to be in the position the dems and court are in and will be for a while? Being blinded by rage as the left is right now is creating many unforced errors.
Sincerely believe every move he makes is well thought out and planned with several scenarios. He is a strategist, not a politician. Imagine! A candidate who actually makes good on his promises. It’s unheard of!
Hugh Hewitt ( no friend of Pres Trump) was incensed by this decision. He said if any of his con law students presented the ruling the 9th circus did, he would have failed them all. I predict this is going to end badly for activist judges.

This is the 3 Judge panel of the 9th Circuit court of appeals…..and quite possible the stupidest judges in our legal system……they cannot even read a law much less determine it’s legality…..what a sorry excuse for judges they all are……..WTF.

How? The difference between Hewitt’s students and the Judges is lifetime appointments. Judges have the freedom to interpret the situation/law at will. The only firewall between sane jurisprudence and activism is Congress. As of now Congress is not in position to do squat because there is not enough Senators (Enough State houses to enact proper Amendments, HOR would be close) that respect proper jurisprudence or begin the process of nuking lower courts.
