As judges on the 9th Circuit Court of Appeals weigh the legality of President Trump’s immigration executive order, a Republican push to split up the controversial court -- and shrink its clout -- is gaining steam on Capitol Hill.
Republican Sens. Jeff Flake and John McCain of Arizona introduced legislation last month to carve six states out of the San Francisco-based court circuit and create a brand new 12th Circuit.
They argue that the 9th is too big, too liberal and too slow resolving cases. If they succeed, only California, Oregon, Hawaii and two island districts would remain in the 9th's judicial fiefdom.

They need to throw in the Western District of Washington, as well. Might as well throw those Seattle liberals in with the other liberals in California and Oregon. Swap it for the ED California - leave them with the conservative districts.
Let’s have Montana out of the 9th!

Just for show. There is nothing they can do here. The power to break it up rest with SCOTUS who must recommend before any action can be taken.

I would like to see this circus split. What does McCain get out of this. the new court will be seated in Phoenix?
A better idea would be to create a new 12th Circuit just for California and Oregon, pack it with conservative judges and let them go to work on the backlog of cases to overturn bad CA laws.
The existing 9th circuit could be house-cleaned of the worst liberals easily enough by moving them to Boise or Pocatello, ID.

Courts (Circuit/District, etc...) under the SCOTUS are Congress’ domain.
Yeah, I don’t trust McCain or Flake either, but even a blind squirrel will find an occasional acorn.

Flake isn’t as much of an attention whore as McTraitor but he is still a back stabbing POS rino. I believe he is up in 18. AZ Conservatives need to get behind ONE candidate early to offset the Rat crossovers in the primary. They are the reason we cannot get rid of McCain or Linda.
It does get the conversation started though and that’s something.
With some luck CA will be split into 3 or more states in the not too distant future.
***IF*** McCain can focus on the real enemy and learn to keep his yap shut on all else, he might prove to be useful.
But that’s a big ***IF***.
