Bill to split 'nutty 9th Circuit' gains momentum

As judges on the 9th Circuit Court of Appeals weigh the legality of President Trump’s immigration executive order, a Republican push to split up the controversial court -- and shrink its clout -- is gaining steam on Capitol Hill.

Republican Sens. Jeff Flake and John McCain of Arizona introduced legislation last month to carve six states out of the San Francisco-based court circuit and create a brand new 12th Circuit.

They argue that the 9th is too big, too liberal and too slow resolving cases. If they succeed, only California, Oregon, Hawaii and two island districts would remain in the 9th's judicial fiefdom.

Splitting up the court won’t solve the problem of leftist judge shopping. If anything, it could make things worse, creating an even more extremist, anti-Constitutional court.

The problem in AZ is we have an open primary. The dems can vote for Flake and they voted for McCain when they could see their candidate wasn’t going to win. A closed primary wouldn’t completely eliminate this problem but it would help a lot.

Just for show. There is nothing they can do here. The power to break it up rest with SCOTUS who must recommend before any action can be taken.

I don’t think this is true. However, It doesn’t matter if it is anyway.
There have been several justices that have been recommending it for years, including Justice Kennedy who sat on the 9th circuit.

True according to a local judge interviewed here - former Judge Jim Troupis (Dane County Circuit Court) - I think - missed some of the interview.

Living in California, I say do this for the rest of America.

Hopefully, Calexit will go into into reality, costing the libs 2 $inators and about a dozen or more liberal Congre$$its.

Then, we can spin off the conservative state of Jefferson with the conservative counties in California, Oregon and eastern Washington counties. That will give us 2 more conservative Senators and several congressmen.

Then, the liberal parts of Oregon, Washington and all of Hawaii can join CalExit.

That will cost the rats 6 more $inators and probably a dozen+ congressits.

The rat party nationwide would never win another presidential elections.

Losing 8 rat $inators and Congre$$its would be the death of their party re national elections and any control of congress.

Then, maybe we will see an east coast exit with NY and the lib states down to DC.

They don't want us, and our feeling is the same. We don't need these coastal liberal hell holes. Let them open their borders and pay for their new "citizens"!

Instead of splitting it and having a fight he should just double the number of Judges in it.

Harry Reid gave Trump all the votes (51) he needs to stack the court...just like FDR did.

I guess I would prefer we move some states into the other courts. The 8th and 10th courts are small. We could just peal away several states into those courts.

The reality is that the 9th court could be only California. Maybe stick one other state in there so its not a state court. But California alone makes it a bigger than average court.

The current 9th could be reconstituted to encompass only the land directly under the building which houses the Court House complex. The remaining current 9th could become the dominion of the new District 12

The existing 9th circuit could be house-cleaned of the worst liberals easily enough by moving them to Boise or Pocatello, ID.

What has Idaho done to you? We have enough libs here, thankyouverymuch.

Well, than I think he is mistaken. I have been unable to find any such rule or law. In fact, we almost got it split in 2005.

Here’s an excerpt:

“Republicans were able to slip a measure splitting the court into a budget bill that passed the House, but the provision was dropped after Democrats in the Senate threatened to block it.”
