Byron York: Justice Department demolishes case against Trump order

James Robart, the U.S. district judge in Washington State, offered little explanation for his decision to stop President Trump's executive order temporarily suspending non-American entry from seven terror-plagued countries. Robart simply declared his belief that Washington State, which in its lawsuit against Trump argued that the order is both illegal and unconstitutional, would likely win the case when it is tried.

Now the government has answered Robart, and unlike the judge, Justice Department lawyers have produced a point-by-point demolition of Washington State's claims. Indeed, for all except the most partisan, it is likely impossible to read the Washington State lawsuit, plus Robart's brief comments and writing on the matter, plus the Justice Department's response, and not come away with the conclusion that the Trump order is on sound legal and constitutional ground.

The judiciary should have virtually no role in immigration policy or policy implementation. None.

Begs the question about what the “Most Partisan” 9th Circus will do when faced with these arguments this week for a full hearing.

From the article linked above, with my emphasis:

"But Washington State argued that it has an interest, as a state, in stopping the Trump order because "immigration is an important economic driver in Washington." The state's lawyers argued that Microsoft alone employs nearly 5,000 H-1B visa holders, and that is in addition to those working for Amazon, Expedia, and Starbucks in the state."

Irrespective of the fallacy of this as a legal argument, this is a serious problem that impacts the economic condition of Americans... not Washington State.

That's the trick with the "Temporary Order". It's only good for 14 days....and all he has to do is say..."I don't think that's right".

So now, he's pushing the envelope...

Do they really want it to go to the Supreme Court? While it is 4/4....maybe...and it looks like that is the plan.

It's just revenge for the USSC 4/4 decision upholding Obama's "do not deport" EO.

Except that is totally different...Obama is breaking the law in that call while Trump wishes to uphold the laws.

Inconvenient?? So what!

I do agree many of the agents decided to act on their own....Was Trump sabotaged??

I’ve seen the 9th side with conservatives when the case was painfully obvious. They do have to present at least the thinnest facade of being legitimate.

I believe this will be one of those cases. The worst they could do was just not give the immediate reversal. Now that they can claim they’ve had time to “think about it”, they can give us their sane answer.

the actual LAW seldom enters into these clowns decisions. Sadly over time this circuit has grown to be the largest in the nation.Dems will not allow it to be broken up, nor will they ever allow a Rep Prez to put anyone close to conservative on this court.

I have a former patient that arrested a Yemen national, who came over from a terrorist camp and he went to federal prison.This was in Virginia several years ago. So this judge is absent some facts.

I’m nearly certain this ‘judge’ was commissioned by David Brock, who is running his own extra-DNC war against DJT that the RATS can’t control or stop. They both wear bow ties, kinda have the same vibe, and I wonder if the ‘judge’ doesn’t have a blackmailable item being hung over his head by Brock.

The smarter ones of the Left realize this is doing more to push the ex-Dem voters closer to Trump, and the more they undermine our safety and rule of law, the more they assure they’ll never get those voters back.

Brock doesn’t think strategically, he just craves destruction. Hard to believe he used to be a ‘conservative Republican’.

You have to wonder whether Soros will be investigated by the Feds. It should be one of Sessions’ higher priorities.

Someone is inciting riots. A lot of intelligent people believe that Soros is paying for it. My question is can they get enough evidence to implicate him in a crime? Seems like the most logical approach would be to start arresting the rioters and squeezing them to reveal who is paying them and how, what are their instructions and from whom are they receiving them?

President Robart seems to have the same intelligence information on terrorism that Trump does.. NOT!!!

Doesn’t matter. The rule of law is unambiguously on the President’s side, bigly. He has statutory authority, case law and the Constitution on his side.

Robart cited no law to support his ridiculous conclusions. Because there isn’t any.
