Why not keep it out of the hands of the judiciary and simply have POTUS instruct the employees of CBP to turn back people from these countries..?

(Even if Bush 43 had been a bona fide conservative, Senate rules would have made it impossible for him to have appointed all conservative judges. Now President Trump has to deal not only with all the liberal judges that Obama stacked the courts with after Reid went nuclear, but all the liberal judges that were appointed by previous Republican presidents.)
What travel ban? Trump never called it a travel ban. Is this like “undocumented immigrants?”
