While that may indeed be true, it unfortunately would be impossible to prove that in a court of law. No where does he suggest that someone should do, only that he thinks, and rather certainly I might add, that someone will do it.

He may have free speech to say this, but he needs to deal with the consequences, and I really hope the Secret Service pays him a long visit—perhaps after they are done dealing with SS woman in Colorado who refuses to defend our president.

It occurs to me, maybe Mattis could send a few marines over to stand guard if SS can't be trusted to do the job.

While we may not be able to prove this to the satisfaction of a liberal judge, it is my thinking that we can toss the bastard in jail and then let him petition the courts to let him back out. The point here is to address the real world consequences of what he and others are attempting to do, rather than throw our arms up in helplessness because we think the courts will go against us.
Even if the courts let him back out, the message will still be sent that if you threaten the President, either directly or implicitly, you will have to deal with a bunch of legal matters with which you would rather not be bothered.

I think there is a way to responsibly state an opinion that an assassination is probable. For one thing, you could give your reasons for thinking it is probable. But it would be even MORE responsible to not tweet it at all. If you were REALLY responsible and had reason to believe an assassination was likely, you ought to report it to the SS.
What this jerk did was to try to incite an assassination. I’m sure if you looked at his twitter history, it would tell the rest of the story. Stating a wish, in hopes that someone else will fulfill it, is coming very close to the line of incitement. (Or maybe it’s over the line. I’m not a lawyer.)
