I think I would argue that being detained at an Airport US Customs and Immigration facility isn’t really “being in the US.” IMO, they haven’t been cleared for entry which is tantamount to ‘not having entered the US.”

They are under US jurisdiction at that time. Let's say there was an assault in the facility by an alien. Would he not be under US jurisdiction for the assault?
