Obama administration chose not to act on pardon request in Bowe Bergdahl’s desertion case

Army Sgt. Bowe Bergdahl, the U.S. soldier who faces court-martial on a charge of desertion after walking away from his base in Afghanistan and spending five years in militant captivity, sought and failed to receive a presidential pardon by President Barack Obama before he left office, according to Bergdahl’s attorney Eugene Fidell.

The attorney acknowledged the effort Friday after Berghdahl’s legal team filed a new motion to dismiss the Army’s case against their client, citing past harsh rhetoric against Bergdahl by newly sworn-in President Trump. The New York Times previously reported the pardon effort was considered, but Bergdahl’s legal team declined to discuss it at the time.

I was a bit surprised he didn’t. I guess Bergdahl hasn’t converted all the way to jihad yet plus him being a white man didn’t help either.

If it can be proven that American soldiers died specifically searching for Bergdahl, he should be put to death.

Speaking of pardons, I take it Hillary didn’t request one.

I’m thinking a deal was made with Trump there. He’s not going after her.

I think that would have been an extraordinary use of a pardon - I don’t believe Bergdahl has been convicted yet.

Yes, I know Ford pardoned Nixon pre-emptively, but that itself was an extraordinary case.

Oh, so Trump calls him what he is, and that makes him deserving of a pardon? the attorney should be disbarred.

Trump said on the campaign trail that Bergdahl should be shot for desertion.

I personally think releasing 5 muzzy terrorists in exchange for him is an even worse offense.

On second thought....not surprising, obama used him to free 5 jihad’s. So Bergdahl was a sacrificial lamb to obama.

I think a deal was made for a pardon for Hillary and her minions way back at the meeting of the Clintons and Obama on Martha’s Vineyard in early 2016.

I suspect Obama delivered on his end right after the election, and it was never publicly announced.

Right.

In all the back-and-forth and confusion about pardon power, it is overlooked that pardons without convictions are so rare that the few instances can be easily listed. Such pardons certainly ought to be exceedingly rare.

When Ford sought to pardon Nixon, he had doubts and so had Phil Buchen and Benton Becker do research. It was Becker who explained to Nixon that accepting the pardon was admission of obstruction of justice.
