The New York Times Christmas Day editorial tags Senate Republicans for stealing a seat on the Supreme Court that should have been filled by President Barack Obama.
The Times accuses Republicans of impugning the institutional integrity of the court by a hyper-partisan charade, arguing the justices derive their legitimacy from their separation from the two political branches of government.
Mr. McConnell and his allies took a torch to that idea an outrageous gambit that, to nearly everyones shock, has paid off, the Grey Lady says. But while Republicans may be celebrating now, the damage they have inflicted on the confirmation process, and on the court as an institution, may be irreversible.

Why didn’t they make more of a big deal for the last sixth months? Because they were holding their breaths hoping that the silent majority would not think about all the lawlessness thrust upon the country by an Obama/Clinton majority court.
Sour grapes hypocrisy. THE Dems threatened this time and again. Look what they did to Bork and Thomas they turned the court into a sister boom boom Freak Show. Now they want to get sanctimonious. Reid would do this if given the chance.
Hey, NYT, I believe that “hyper-partisanship” was started by the Democrats in the 1980s with a certain Robert Bork. When I look at Justice Kennedy I think of the opportunity the Democrats “stole” from us. Then not even that many years later, they tried it again with Clarence Thomas, who barely squeaked by in his confirmation.
If you dislike the Court being politicized, take it up with the Dems. McConnell was working within the politicized framework that the Dems created. And this move was the highlight of his career. If the Dems didn’t want him to have this power, they should have worked harder to win the Senate during the mid-terms.
