Michigan Court of Appeals Agrees to Hear Recount Case

This is why she stopped her action at the state level. How did she know IN ADVANCE she would get a sympathetic judge? Hmmm..

Larry will tell you that MI certified their electors last week so therefore this is all kabuki theater. Done deal as far as the state of MI is concerned.

The Obama appointed judge is aware of being stopped by another court. A good write up here in the Detroit local news.

Similar to Bush v. Gore, action can occur in state and federal venues simultaneously.

In this case, the state election commission deadlocked (on recount or not, period), so Trump's objections were rejected. Appeal of that decision is what the OP is about.

What the federal court did was over-ride the MI law that says recounting is to wait for two days while the loser below (Trump) gets his appeal of right. A recount was going to happen unless reversed by the state court.

The State can tell the Fed Judge to go f’off on issues of State (US) Constitutional Duty. If time were of the essence, S0r0$ should have had Jill file for a recount the day after the election. Waiting for the last moment doesn’t create an emergency.

Yeah the fed judge said he’ll be the one to determine if the recount was stopped.
If the state courts rule to stop it, the fed judge will have to agree.

But *THE MOST INTERESTING THING THE JUDGE RULED*...
Michigan can charge their costs against Stein’s fee- even if the recount is stopped. She could lose ALL that fee and not even get a recount LOL!

Umm, no. Read Judge Goldsmith’s ruling. In his conclusion, he said the recount would start and continue under his order, the state would assemble sufficient staff and work enough hours to get it done. Sounds to me like he removed the state courts from the process. He also ordered that any defendants associated with this would cease all opposition.
