Stein switches tactics in Pennsylvania recount drive (Filing in Federal Court)
Yahoo News ^ | December 4, 2016 | Staff

Former Green Party presidential candidate Jill Stein switched tactics in her campaign to force a recount in Pennsylvania, one of three battleground states won by Donald Trump where she has challenged the results.

The party dropped a bid to pursue the recount in a state court, citing difficulties raising a million dollar bond demanded by the tribunal. It said it would instead press on in federal court and file suit Monday.

That was also Stein's deadline for raising the bond money.

"Make no mistake -— the Stein campaign will continue to fight for a statewide recount in Pennsylvania," attorney Jonathan Abady said in a statement.

"Over the past several days, it has become clear that the barriers to verifying the vote in Pennsylvania are so pervasive and that the state court system is so ill-equipped to address this problem that we must seek federal court intervention," Abady said.

"Petitioners are regular citizens of ordinary means. They cannot afford to post the $1,000,000 bond required by the court," read a filing submitted earlier in the Commonwealth Court of Pennsylvania, announcing the state court drive was being dropped.

Stein plans to hold a rally on Monday across the street from Trump Tower in New York "vowing to fight tooth and nail to verify the accuracy, security and fairness of the vote," a statement read.

The state of electors has been sent to Congress so, at this point, unless recounts change this, MI is officially certified for Trump.

Thanks for info about ‘ripeness’.

Ping;

Not all avenues were exhausted; she folded at the state level point, so fed ploy shouldn’t go anywhere.

Michigan hates her, both sides. It will cost this state 4-5 million in taxpayer money and no Michigander thinks we can afford this.

So on mlive the comments are all hateful of her or disgusted in general.

8 SCOTUS members, deadlocked 4:4 is where you’ll find the relevant law.

In case of a tie, the lower Court ruling is affirmed.

But. That requires it be a Federal case, not a State case that would move through the State Court system.

Forum shop to get a decision and an appeal in the hands of the right Judges in the Federal Court system has been the goal all along.

That said, the ball is in the GOP’s court, and always has been. Even if the Dems can get a ruling ceding them PA, WI, and MI (not likely, this is the hailest of Marys), the Congress can simply refuse to validate those new stolen electors and then the decision would fall to the House. Rinos or not, the party would have no choice but to defend their President. Failing to do so would be worse than voting for Obamacare.

Personally I think their end game isn’t to “win”, but to destabilize the EC. If they can force the House to intervene, they’ll scream for a PV with the moral indignation of the bonfires of Hell.

Assume that any Federal Judge that takes this case knows that a deadlocked SCOTUS assures that their decisions can be played for effect.

The Green Party just dropped its recount suit in Pennsylvania and is losing votes in Wisconsin recount. Just a Stein scam to raise money!

SCOTUS had no choice but to intervene in 2000 as a function of Judicial accountability. Essentially, they told the Florida Court to cease and desist trying to cherry-pick the result for Gore.

Otherwise, the Presidency would have been decided by the Courts. The left can cry all they want that that is what happened anyway. It is not. SCOTUS pushed aside the interference of the Courts in order to allow the state of Florida to decide its outcome.

The involvement of SCOTUS was unfortunate but necessary to protect the integrity of the process. SCOTUS only altered the process by blocking a lower Court from interference. Florida decided its own outcome, not SCOTUS. Barring that blockade, the lower Court would certainly have successfully interfered with the outcome.

SCOTUS’ involvement was unfortunate but critical.

75,000 people in Detroit who voted left the President blank and just voted down ballot. How can that be? This is what an ignorant Stein asked Chuck Todd Sunday morning.

The reality is that Americans have a long history of under-voting a specific race where they want none-of-the-above.

As I have pointed out on vote fraud threads, the most common vote fraud during the counting phase is for the party that controls the counting to count the undervote as a vote for the favored party. Their explanation is that the voter was confused and really did not want to leave that race blank. So they are just implementing the wish of the voter ... if the voter had not been confused by all those lies of the other side.

It would appear that this time, the vote counters in Detroit failed to do what was expected of them. Of course, I learned politics in Illinois. Maybe I shouldn’t be so cynical about a less corrupt Detroit.

Which means they may have found or bought off a judge that will grant it.

would not surprise me

I doubt they would be going this direction if they didn't already know the result

Dem is bragging on Kos about doing this in Pa ,

The Chester County (PA) Democratic Committee (CCDC) collected enough affidavits to have at least 60% of our precincts recounted. We collected over 400 affidavits in about 3 days to force this recount. An exceptional effort.

This recount is independent of the court-ordered recount that the Stein campaign cancelled. We took our affidavits directly to Voter Services, not the court system. It is being done at no cost to the petitioners. Two officers of the CCDC led this effort with strong support from our Zone Leaders and Committee Persons. It should be noted that we did this as volunteers for the Stein campaign, not for any other political party or organization. We had good support from the Stein campaign who sent two lawyers to Chester County to help us with the legal details.

It should be noted that we have paper ballots in Chester County which are counted by machine. Chester County is one of only 6 or 8 counties in Pennsylvania which vote using paper ballots.

And in fact it is not true. The recount here in MI is still being deliberated. Next set of info on this will be on Tuesday.
