The Supreme Court decided in Texas v. Johnson that burning the American flag, no matter how distasteful, is constitutionally protected free speech. The decision was not unanimous. In fact, it was a 5-4 decision and one of those siding with the majority was the late Antonin Scalia.

"Currently, flag burning is not illegal in the United States. The Supreme Court of the United States in its decision from 1969 has ruled that the burning of the flag is protected by the First Amendment. However, the person who burnt the flag can be found guilty of a misdemeanor for starting a fire without a permit"

No 5 to 4 in the SCOTUS as free speech. 1 vote short of the 1 vote needed in CONgress I heard this morning.
