Wisconsin Recount Filed 2016: 5 Fast Facts You Need to Know

A recount of the 2016 presidential election results in battleground Wisconsin will start next week, adding new drama to an already contentious election filled with surprise twists.

The recount comes after a group of professors and lawyers raised concerns about the possibility of hacking. Donald Trump decried the recount as a “scam” in a statement on November 26.

The Wisconsin Election Commission “is preparing to move forward with a statewide recount of votes for President of the United States,” Administrator Michael Haas announced in a written statement on November 25.

The recount was requested by the Green Party after its nominee, Jill Stein, raised more than $5.4 million in just over one day to fund recounts in Wisconsin, Michigan, and Pennsylvania, all states that were surprise upsets for Donald Trump and which he won by fairly small margins.

To Wisconsin Election Commision members:
        Please bring up this subject as soon as possible in your next commission meeting.

Under Federal law, 3 U.S.C. § 5, (the safe harbor provision)
The Wisconsin WEC does not have the authority (post-election) to change Wisconsin law regarding the validity of petitions requesting a recount.

Specifically, Wisconsin mandates that for a recount petition to be valid, it must have included payment of the estimated recount-cost at the time of the petition. The deadline for petitions was Friday 11/25. Ms. Stein did not pay even one dollar toward the estimated recount-cost at the time of her petition, therefore her petition is not valid, and the WEC does not have authority to bend or change election law after the election.

Are we sure no payment was submitted at the time of the filing? From the WI recount manual:

When a filing fee is required, the cost of the recount should be estimated by the clerk and pre-paid by the petitioner in cash or in another form of payment acceptable to the filing officer at the time of filing. Wis. Stat. § 9.01(1)(ag)3.

“We have assembled an internal team to direct the recount, we have been in close consultation with our county clerk partners, and have arranged for legal representation by the Wisconsin Department of Justice,” Haas said. “We plan to hold a teleconference meeting for county clerks next week and anticipate the recount will begin late in the week after the Stein campaign has paid the recount fee, which we are still calculating.”

It's hard to imagine a Republican at either the state or national level actually broaching that argument.

But Trump will.

Pennsylvania is the real firewall here. Stein has to make a showing of cause before a court. And she has already admitted she doesn’t have such. Game over.

Have you sent this to Team trump and the WI GOP? LS you have contacts within Trumps inner circle. Maybe you can pass this along so they can recount thrown out in WI Court due to WEC changing recount rules after the election in violation of federal law.

No, they’re not certified until the time to challenge has passed or, if challenged, when the recount is completed. I believe in all cases the final certification must be done by 12/13 or so, a few days before the meeting of the Electoral College. The laws differ from state to state so some states might now be certified, as WI would have been had Stein not filed her challenge last Friday. MI and PA have deadlines next week on Monday and Wednesday (can never remember which is which)

She didn’t pay because they could not tell her how much to pay. No judge, no CONSERVATIVE judge, would disallow her request for this non payment reason.

This is foolish.
