Trump Adviser Kris Kobach Warns: No 'Free Pass' For Undocumented Immigrants
NBC News ^ | 11/15/2016 | SUZANNE GAMBOA

President-elect Donald Trump's immigration adviser Kris Kobach warned Tuesday no one living here illegally will get a "free pass" and predicted many immigrants would leave as jobs and benefits "dry up."

Kobach, one of the architects of Arizona's anti-immigration law SB1070, made the statement on Fox News when he was asked what Trump plans to do about people who are illegally, but are working hard and are not regarded as criminals. Kobach reached back to the immigration speech Trump made in August in Phoenix, when there were thoughts then-candidate Trump might be easing his view on immigrants.

In that speech, Trump said "every person in this country has to follow American law. No person living here illegally gets a free pass, like they did under the Obama administration," Kobach said.

"The jobs are going to dry up, the welfare benefits are going to dry up, and a lot of people who may not be criminal illegal aliens may decide, hey, it's getting hard to disobey federal law, and may leave on their own," he said.

Undocumented immigrants cannot receive the government benefit that is often called welfare, but is officially known as Temporary Assistance for Needy Families. They also cannot apply for healthcare or other benefits.

The federally and state funded program is designed to assist children, so a U.S. citizen child of a parent not legally here, can qualify for it. The same may be true for health care or other programs.

The "self-deportation" idea has raised questions in the past about how far officials will go to "dry up" any benefits. It can create problems when applied to mixed status families, particularly when parents are illegally in the country but children are not.

Trump completing the negotiations with illegals that have been implicitly ongoing since the start of his campaign. Many will just leave.

The children have dual citizenship. They are citizens of the countries their parents came from. These countries should welcome ALL their returning citizens - young and old alike.

The "loving" parents shouldn't abandon their children in America. They need to keep the families intact. Bring their children home with them.

Not a problem. The illegal parents have to go. Period. They can, of course, take their children with them; we won't kidnap them. If they choose to abandon their legally-here children, we'll take care of them, but they have to go.

That would be a FELONY, Child Abandonment.

Absolutely agree with you. Many of these illegals left other family members behind when they came to the US illegally.

No sympathy from me. Take your kids home and try and come back legally. Get in line like legal immigrants have done for years.

The “loving parents” shouldn’t have been so irresponsible as to put their children in this position in the first place. I Can’t imagine, if I had kids, bringing them into another country where I might eventually be deported, leaving them to fend for themselves or wards of the state.

By the way I despise the term “undocumented”...they’re ILLEGAL dammit.

This is something liberals don’t understand or won’t. A number of sheriffs and mayors are rattling their sabers, saying they will continue to be sanctuary cities. I don’t think they understand just how many people in DC are ready to pull any and all funding they can, or what legal repercussions might crop up. As it stands, according to what I heard this evening, by using the 10th amendment, they may be able to sidestep legal troubles, until the Trump admin decides to go in with a subpoena. Then it gets sticky. I’m pretty sure trump knows this, or will soon.

It seems though, refusing to turn over a felon wanted by ICE would fall under a couple of statutes. Obstruction of justice, violation of oath of office, maybe harboring a fugitive...

I don’t understand all the legalities, I’m not a lawyer and I don’t play one on TV, but it seems there should be a way to get some of these bozos to either follow the law or get them thrown out of office. I’m sure their loyal supporters will never impeach them, they believe the propaganda that got them to vote for the slimeballs in the first place. One way or another, this has to stop. We can’t keep doing things the same way and expect different results.

“It can create problems when applied to mixed status families, particularly when parents are illegally in the country but children are not.”

In a more sane time, the inherent contradiction of that sentence would be evident.

Constitutionally, if the parents are illegal, then the children are too, no matter where they were born.

The anchor baby doctrine has to end. The way I understand it, the concept is merely a agonized interpretation of law, so the removal of the status would be retroactive.
