Pretty sure it is the new. They’re sworn in at the beginning of January, and when the present process was put in place, the president didn’t take office until late March.

Delegates have done their piece for this election. They are done. No more voting for them except like us peons — in the general. 1 vote each. A tie goes to the current House of Reps for a vote and final decision. It would not be a tie in the House, guaranteed.

The CURRENT house (including senate) does the vote. It is an “immediate” tie-breaker vote per 12th Amendment.

It was the race between Jackson and JQ Adams (if I recall.)

The ONLY reason I remember this is because it was on TV the other night. I did not know that Jackson ran more than the one time.

Old.. because the new House won't have been sworn in yet.

The new Congress. Their term begins on Jan 3, the counting of electoral votes is on Jan 6.

It depends on when the Electoral Election is. I used to think it was in January. If that is the case, the new house would vote for President and the Senate would pick the VP.

Someone said the other day its in December. I have no idea how they would deal with that.

We need an amendment to the Constitution that requires each member of the Electoral Congress to cast their ballot for how each of their Congressional District voted, not state level winner take all.
Senators who are each states member of the Electoral Congress should be required to vote how their state legislature decides during a special legislative session between election day and the the Electoral College Vote.

After all aren’t Senators supposed to represent the interest of each state, and not multinational corporations, who fund their campaigns?

Only then will we see an accurate representation of the the American People, reflected in the office of President.

As a result the massive voter fraud in large urban district will be limited to just their district, and the President will truly represent the will of the People of the United States.

Why is that a nightmare? (or worse, a “constitutional crisis”).

It’s all laid out in the Constitution. I’m sure the Founders thought the House would elect more Presidents than they have.

Unfortunately there are plenty of “Never Trumpers” in the house and senate. It would definitely be close and lots of palm greasing going on. The key would be to do the vote FAST, and not allowing enough time to turn into a complete corruption circus. Guess that’s why the 12th Amendment specifically states “immediate” vote.
