I’m pretty sure that if malice can be proven, the public figure issue won’t make a difference.

Agree completely. Libel and slander is clearly defined. If Trump doesn’t win the election, he may soon own a newspaper.

Their primary defense would probably be that you have to prove that the paper knowingly published a false story or acted "with reckless disregard of whether it was true or false."

That's called "actual malice." The case that gave the ruling is even named after them: New York Times Co. v. Sullivan 376 U.S. 254 (1964).

Trump DOES have a case

It is proven there is collusion between the New York Times and the Clinton campaign

F McGraw!

He knows damn well nothing matters except if the charges are true or not.

If they aren’t, he’s going to cost the NYTs a bundle.

Further, he’s all high and mighty about their voices being heard. Has his paper let the voices of Clinton’s rape victims be heard, something far more personal and damaging, for life?

Did his paper publish the account of the 12 year old who Hillary laughed at and called a tramp, after defending a man she knew was guilty, successfully getting him off?

Did the paper mention that she was brutally raped at 12 years of age, beaten so bad she was left in a coma for days, and was never able to have children do to her injuries?

Hillary Clinton denigrated her and laughed at this 12 year old rape victim, victim of a brutal beating, left in a coma for day, and unable to have children EVER.

F this di—less jerk and the paper of no morals, no class, and “no-record” as well.

Isn't the verified story of how Clinton celebrated how she got the rapist off with time-served by debasing the 12-year-old victim and by having the damning evidence (the child's blood-soaked panties that were contaminated with the rapist's semen) thrown out on a technicality of "national importance"?

Do you think the NYT is going to be consistent with their editorial philosophy and publish that story so as not to commit "a disservice not just to our readers but to democracy itself to silence [Kathy Shelton's] voice"?

I’m sure they had this much concern for Clinton’s victims. Not.

The NY Times was not about to let go of an issue that harms the Trump campaign and candidacy. To them, as well as the democrats, the goal is to win at any cost. The NY Times, along with the majority of the media, are just the “media wing” of the democratic party. If Hillary wants to keep the lies about Trump in the “news” then the NY Times and all of the democratic party media machines will comply.

To Hillary and her complicit media, causing as much damage now to Trump is all that matters, even if they are all or almost all, lies. With just over 3 weeks left in the campaign, they know that Trump cannot respond soon enough to stop the lies, and by the time that Trump had a chance to respond, through lawsuits or whatever, the election season would be over, and Hillary might have gotten elected. Once the election is over, and Hillary has won, it would be too late for Trump to do anything about it, and the election could not get a “do over” if it did turn out that Hillary and the Times and all others were, indeed, lying about Trump “abusing all those women”.

What Hillary and the media are doing, is running scared, and so, they had to create preemptive campaign full of lies about Trump abusing women. Hillary and her campaign and the liberal media expected Trump to march out a list of women who were abused by Bill Clinton and Hillary, so, Hillary and the media just wanted to turn the tables on Trump, and so, that’s where we’re at now, with Trump getting bogged down defending himself, and Hillary reaping the benefits.

Hitler and the butchers of the old USSR and China and Cuba and Venezuela, would be very proud of the tactics being deployed by the Hillary campaign and the complicit liberal media. The USSR had Pravda as their media operation, while Hillary and democrats have most of the media serving as their Pravda.

The U.S. will, at sometime in the future, end up like the old USSR, in shambles.

Their journos are sluts and whores, just like the “accusers”!!!!

I make sure NEVER to buy the NYT, and NEVER to pay for their online articles!!!! (There are good ways to do the latter.) The same goes for my other two FORMER favorites, the Boston Globe and the Washington Post.

Perhaps an increasing number of people can do this, and we can put them all out of business in a year or two!!!!

I can’t believe the outright nerve of this 3rd rate newspaper!! It’s unreal!

It's very real and it's a trap Trump is falling into by his own actions.

The Hillary Campaign is trying to make Donald Trump guilty of exactly what Trump is accusing Hillary of doing - destroying the lives of women who make charges of long ago real, imagined or totally fabricated sexual offenses against Trump.

Just because the Clinton/Media players seriously sociopathic people who could care less the damage they do to the country does not mean they are not fiendishly clever propagandists

Trump should consider responding by attacking the Clinton Campaign and it's Media surrogates for using these women as anti Trump weapons but scrupulously avoid attacking the women themselves who are making the totally unsubstantiated sex charges.

Trump might even consider calling a spade a spade and declaring that the above is exactly what the media's plan is and calling them on it help to defuse the attacks effectiveness.

Trump is investing some nine figure amount in his effort to win the Presidency. If that all comes for naught, I wonder if some jury might conclude that it was due to this recklessly false story the Times printed. It could be the end of the Times as we know it.

The Times can claim that Trump had a poor reputation before so their story wasn't significant. But I was a voracious Times reader for 50 years or so before I abandoned them, and I cannot recall anything they ever wrote during that time that was critical of Donald Trump.

Not a good or smart letter from a purely legal standpoint. A one sentence “General Denial” is what most lawyers would recommend in a case like this.

But, it’s Presidential Politics...........so “what the hell”.

Don’t expect they will rollover but I expect Trump will win in the court of public opinion because all people f’ing hate the f’ing press. It feels like to me that Trump is toying with them at this point. He knows how to win. I am now convinced of that fact. I think he is doing things we have no idea what they mean at this moment but when he is ready for us to know then all be known.

As much as I hate to say it, Trump doesn’t have a case here.

Perhaps. It is a legal issue that will drag on for a while ... long after the election. A better result than possibly getting money out of the NY Times would be to send some of these people to jail. I would think airing his tax returns would be a criminal matter involving the specific people that took this action.
