Trump is a public figure and has been one for many years. Once he became a candidate, there was no doubt that he is a public figure. Being elected isn’t a requirement.
Defamation standards for public figures include “actual malice.” But that standard isn’t as difficult to meet as some think: if the times knew it was incorrect — or didn’t care whether it was correct or not — and published it, they have engaged in actual malice. I’m sure someone on here can further clarify the exact elements of the tort and perhaps give some caselaw insight into how these elements have been interpreted, but this is the gist of the standard.
