The fact of the case was that this mutant was on probation for a number of crimes, including drug possession and bank fraud. Part of the fraud case against him was based on his role in opening multiple phony bank accounts using the Social Security numbers of other people.
He was jailed not because of the stupid video, but because his role in creating and uploading that video was in direct violation of his probation (he wasn't allowed to access the internet without authorization from his probation officer, for example).
