A candidate conceding or not conceding is meaningless. There are no legal ramifications whether one concedes or not. When a candidate concedes, it is just considered good manners.
If Trump does not win and does not concede there is no need for a SC intervention. Whoever wins the electoral college when they take the vote in December is the winner.
