A young man was killed by a shotgun blast near a Raleigh home Sunday morning and the homeowner where the shooting happened has been charged with murder, Raleigh police said.
[SNIP] During a 911 call at 12:57 a.m., the caller said that he fired a shot while several people were outside his home and they had guns.
We have a house.. we have a lot of people outside of our house yelling and shouting obscenities. I yelled at them please leave the premises. They were showing firearms, so I fired a warning shot and we got someone that got hit, the 911 caller said.
I dont know if they are shot, I fired my warning shot like I am supposed to by law. They do have firearms and I am trying to protect myself and family, the 911 caller said. I dont know who they are There is a park right down the road.
Please send PD! (inaudible) males outside my (inaudible) house with firearms.. Please send PD! the 911 caller said and the call then ended.
About 7 minutes before that call about the shooting, another caller who claimed he was with the neighborhood watch complained about people on Singleleaf, requested police and said he was going to secure the neighborhood.

I understand that - It was a different call. Which is all the more reason to have your warning flags raised about it. That’s damned strange.

Everything you said. Well, almost. In this scenario a stationary defensive ONLY position is warranted. But the smart armed citizen needs to know when to simply RUN.
Anyone who runs into danger without a ROE or a military officer ordering them to is foolish. Not stupid - I wouldn’t say that.. but foolish. When shots are being fired near my family, friends or even in most cases other people it’s my duty to react but if there is no imminent threat then just stay the hell down and live to see tomorrow.
Taking out armed criminals is above my pay grade.
I think you're confusing different 911 calls. The guy arrested for murder shot from his own garage according to his 911 call. He wasn't walking into a dumb situation. He was inside his garage, armed up, and called the cops. He was prepared to defend himself and his family.
A different, earlier call, was recorded where someone stated he was going out to secure the neighborhood.
This guy was on his own property, and inside his own garage. Not that that changes the warning shot issue. The article only mentioned the dead aspiring rapper being outside the garage, but didn't give a distance.
If it turns out that he is both the "secure the neighborhood" caller, and the shooter, then things change. Until we have all the facts, then I see it as a very scared homeowner saying something stupid, but doing what he could with respect to the perceived threat. I want to know where "outside the garage" the dead aspiring rapper was. If he was right outside and advancing, no bill on the shooter. If he was off the property, and not advancing, go forward with prosecution.
