Sony/ATV Music Publishing which administers Queens catalog including songs such as We Are the Champion said a statement Tuesday they have repeatedly asked Trump not to use the We Are the Champions, which he played Monday during the first day of the Republican National Convention. Last month, Queen guitarist Brian May also wrote a blog post protesting the use of the song by the Trump campaign.
Sony/ATV Music Publishing has never been asked by Mr. Trump, the Trump campaign or the Trump Organization for permission to use We are the Champions by Queen. On behalf of the band, we are frustrated by the repeated unauthorized use of the song after a previous request to desist, which has obviously been ignored by Mr. Trump and his campaign, the statement read.
Trumps representative did not respond to questions about the Sony/ATV complaint Tuesday.
Queen also tweeted they were unhappy about Trumps use of the song on Tuesday: An unauthorised use at the Republican Convention against our wishes.

Not at all true. Not even close. When an artist gives a cease and desist, your options are limited at best.
Don’t get me wrong though. This happens all the time.
Trump will stop using the music currently forbidden, Queen, Neil Young, Rolling Stones, etc and use music from another band without permission. They send a cease and desist and he moves on....

Freddy Mercury is the composer. His heirs own the rights to the song, not May.
Brian May has no more right to this song, than my cat fluffy. Brian May has no more authority to tell someone to stop playing this song than my dog bingo.

We go through this same crap with lefties every four years. As long as Trump bought the CD or paid 99 cents to iTunes he can use the song without any further permission. It’s no different than having a backyard pool party and playing songs all afternoon for your guests. The only time it becomes an issue is if someone charges a fee to hear the music. In Trump’s case people are coming to the GOP convention and the music is ancillary to the event, they are not going to a ‘concert’.

Long ago I think I did read about some convoluted provision in the copyright code that required a complex notice process to stop what would otherwise be a permissible public performance. It was something that was nontrivial, it sounded like a phone call or email wasn’t nearly enough.

I don’t know about anyone else but I think the music stinks at the convention. I’m of the generation that can’t and won’t even call it music... I guess anything less wouldn’t be acceptable to the crowd - but there ARE a lot of oldsters there like me!!!

With the onset of social media, things have changed a bit. They can slap you with prohibitively high fines compounded with court proceedings. Especially if an event is charging a ticket price.
They have shut down Youtube channels in a moment’s notice and banned the user from posting due to it. It hurts when they are actually making a living doing this and a mistake is made.
But again, he will move on to other groups and make the same apology tomorrow. Standard practice.
