FBI Rewrites Federal Law to Let Hillary Off the Hook

There is no way of getting around this: According to Director James Comey (disclosure: a former colleague and longtime friend of mine), Hillary Clinton checked every box required for a felony violation of Section 793(f) of the federal penal code (Title 18): With lawful access to highly classified information she acted with gross negligence in removing and causing it to be removed it from its proper place of custody, and she transmitted it and caused it to be transmitted to others not authorized to have it, in patent violation of her trust. Director Comey even conceded that former Secretary Clinton was “extremely careless” and strongly suggested that her recklessness very likely led to communications (her own and those she corresponded with) being intercepted by foreign intelligence services.

Yet, Director Comey recommended against prosecution of the law violations he clearly found on the ground that there was no intent to harm the United States.

In essence, in order to give Mrs. Clinton a pass, the FBI rewrote the statute, inserting an intent element that Congress did not require. The added intent element, moreover, makes no sense: The point of having a statute that criminalizes gross negligence is to underscore that government officials have a special obligation to safeguard national defense secrets; when they fail to carry out that obligation due to gross negligence, they are guilty of serious wrongdoing. The lack of intent to harm our country is irrelevant. People never intend the bad things that happen due to gross negligence.

Sorry to burst your bubble on this one but 1) Trump is far from succinct on most communication 2) we did not nominate anything close to a conservative that would understand this statute let alone speak to it.

We wanted someone to shake up Washington but not a constitutional conservative. Now we must live with those decisions. I’m not holding my breath with any expectation he even mentions this. In fact I can’t recall hearing him citing constitutional principles.

Don’t get me wrong I’m voting for the guy but not because he is a polished speaker

Obama knew she was going to be cleared back when he endorsed her. Lynch would not have said she will do what the FBI recommends without knowing what they would recommend. This is not a representative Republic or a democracy. No votes are taken in DC before knowing what the outcome will be. The US government is corrupt to its core

This is SOP now for the government from the Supreme court, the administraion and now the FBI.

Laws are now rewritten at will by officials charged with their enforcement.


Absolutely friggin’ spot-on. These crooks are rubbing our faces in it, and expecting us to thank them. I’ve had a belly full.

Let's take Comey at his word that there are no 793(f) cases that are close enough to justify taking a chance at trying that offense. I'm not saying he not lying about that, just that for talking purposes, let's assume that.

Comey's duplicity is ignoring the existence of lesser offenses, namely 18 USC 1924(a). If 793(f) is "like" 2nd degree murder, and the facts don't show the type of intent necessary to make that charge stick, that does not mean a manslaughter charge is also out of the question.

The facts in Hillary's case easily satisfy 18 USC 1924(a). There is ample precedent here.

Of course it is - did you forget Obama is President? You're all blaming the wrong person. NOTHING COMEY COULD DO WOULD HAVE RESULTED IN AN INDICTMENT. So he did the next best thing - he proved she broke the law, and then said he didn't, IN ORDER TO PRESERVE THE REPORT.

It's the report, the findings of the investigation, the ones that match the violations of federal law, that matters here. Not Comey's recommendation. His recommendation was NEVER going to make ANYTHING happen.

This way, though, he proved Hillary broke the law and gave Trump the firepower to say so LEGALLY - and prosecute her when he becomes president.

On the lighter brighter side both James Comey and Loretta Lynch will have secure jobs when Hillary wins the election with the help of voter fraud...

AND

...the FBI will finally get the building updates and improvements they've been asking for all these years.

Not that there's any 'intent' to influence on the part of the FBI or DOJ ... ( what's secret and hidden in a person's heart - - can only be imagined by those 'special' people - the ones who KNOW elites never intend for anything bad or criminal to happen. Yes, THEY are always innocent.) so the FBI building updates, improvements, and new hires aren't connected in any way to the pass given to all Democrats today... and either are the invites to the A-List Parties that Comey and Lynch started receiving a few weeks ago.

If Obama pardons Hillary before the election that makes Hillary look worse imho. Trump’s job before the election therefore is to make Hillary look bad and force Obama to pardon Hillary.

After the election hopefully they can find something else to hang on Hillary or her trailer trash family members a la Capone or ham sandwich. At that point I for one would welcome some creativity from the feds.
