“To be clear this is not to suggest that in similar circumstances a person who engaged in this activity would face no consequences. To the contrary those individuals are often subject to security or administrative sanctions but that’s not what we’re deciding here. “

What’s the difference between someone who leaks classified information by the boatload and someone who actively spies? Perhaps some difference im the law but not in overall effectiveness.

Ari Fleischer Verified account @AriFleischer

If Hillary were still Sec State, Pres O would have to fire her. But instead, he travels with her and seeks to promote her. Disgusting.

Not only has Comey proved himself a dishonest weasel, but he openly took the heat off Lynch and the DOJ by asserting so recklessly that “no reasonable prosecutor” would indict.... when we have already found an obvious example of just such a prosecution by our DOJ:

Peak FBI Corruption? Meet Bryan Nishimura, Found Guilty For “Removal And Retention Of Classified Materials”

...What is even more shocking is that according to Comey, “we cannot find a case that would support bringing criminal charges on these facts.”

Well, we did. Here is the FBI itself, less than a year ago, charging one Bryan H. Nishimura, 50, of Folsom, who pleaded guilty to “unauthorized removal and retention of classified materials” without malicious intent, in other words precisely what the FBI alleges Hillary did (h/t @DavidSirota):...

A person of any integrity could not outline the facts of the case against Hillary as Comey did today, with clear reckless violations of multiple statutes, and then say, “oops, no reasonable prosecutor will indict”.”

In fact, FReepers have already located a case which OBVIOUSLY rebuts Comey’s weasel move:

So explain, please, why not? Let me guess. The higher-ups (Obama and his Muslim Bro-hood operatives) have given the signal to give Hillary the get out of jail free card. Well now, I feel a revolution is in order. Care to join me?

I commented on that thread.

If you think of 793(f) as a parallel to murder 2, Comey may be right, the facts don't add up to that.

But that doesn't mean the facts don't add up to the classified material equivalent of "manslaughter," 18 USC 1924(a). The case in that thread is a 1924(a) case, I've linked to the indictment a few times. But today, all Comey talked about was the elements of 793(f), an offense of substantially different character.

Elliott Richardson resigned under similar circumstances, IIRC.

A lot of Freepers consider Elliot a RINO, but he definitely had the courage to "walk the walk." He also landed with the first wave of the Fourth Infantry Division on Utah Beach on June 6, 1944. Would Comey put his life on the line for ANYTHING?

Some may remember this one during the Clinton Admin. Billy boy gave one of his pardons on the last day to former CIA Director John Deutch.

- - - - -

"Deutch left the CIA on December 15, 1996[1] and soon after it was revealed that several of his laptop computers contained classified materials designated as unclassified.[clarification needed] In January 1997, the CIA began a formal security investigation of the matter. Senior management at CIA declined to fully pursue the security breach. Over two years after his departure, the matter was referred to the Department of Justice, where Attorney General Janet Reno declined prosecution. She did, however, recommend an investigation to determine whether Deutch should retain his security clearance.[7] President Clinton pardoned Deutch on his last day in office.[8] Deutch had agreed to plead guilty to a misdemeanor for mishandling government secrets, but President Clinton pardoned him before the Justice Department could file the case against him.[9]"

I know it is not legally meaningful, but I would love someone with a voice stress analyzer to run it on Comey’s speech and report the results for all to consider.

AMEN.

INDEED HE IS...He certainly tarnished his so called ‘Sterling Reputation’.

We Americans can not trust the IRS as the government let Lois Lerner walk FREE, and now the FBI allowed, granny Benghazi, the wife of an accused rapist, walk FREE. so just who does the American people now have to trust??? Certainly not the guy in the White House who has a female Muslim controlling him and what he does..so the liberals, and democrats now want to put a female, lead by another female Muslim in the White House...

I DON'T THINK SO...WE NEED TO FIGHT TOUGH, SUPPORT DONALD J. TRUMP...LET'S ROLL VOTERS.

Any Prosecutor, who does not want to tilt with windmills, will consider the problems in a controversial situation, before he seeks an indictment. The fact that the public does not understand the thought process that goes into prosecuting any case, criminal or civil, does not mean that there is no thought process involved.

This said, it is entirely possible that James Comey saw many aspects in today's announcement, that you are overlooking. It not just possible, but probably, that he has locked Mrs. Clinton & the Administration into a distinct disadvantage for this fall.

Comey said "facts don't support 793(f) case." Nishimura is not a 793(f) case, it is a 1924(a) case.

Comey's exposition makes clear that his review of precedent was limited to 793(f) cases.

All the cases prosecuted involved some combination of: clearly intentional and willful mishandling of classified information; or vast quantities of materials exposed in such a way as to support an inference of intentional misconduct; or indications of disloyalty to the United States; or efforts to obstruct justice.

That is probably true for 793(f) cases, just like murder 2 requires an intention to kill somebody.

But as the Nishimura case shows, there are other statutes.

I point this detail out so that people recognize the arguments about "intent" (part of the court lore of 793(f)) as avoiding the crime that certainly was committed.
