Federal Judge: U.S. Constitution Is Outdated, Judges Should Stop Studying It

According to 7th Circuit Judge Richard Posner in a post published to Slate, U.S. judges should stop studying the Constitution.

“I see absolutely no value to a judge of spending decades, years, months, weeks, day, hours, minutes, or seconds studying the Constitution, the history of its enactment, its amendments, and its implementation,” Posner argued.

“Eighteenth-century guys, however smart, could not foresee the culture, technology, etc., of the 21st century,” he continued. “Which means that the original Constitution, the Bill of Rights, and the post–Civil War amendments (including the 14th), do not speak to today.”

It is really, really tempting to worship technology. Because something is gimcrack and gee-whiz, doesn’t mean we have to organize our lives around it, however. How much mind do we waste away on TV?

Well, it might be time to take the same principles that framed the Constitution and restate them in modern terms. A lot of people would be surprised at the social implications, once the fuzz of archaic terminology was cleared up. While the Constitution shouldn’t order society how to live, it can furnish an invitation to a wiser life when it is understood.

Posner is a very big name judge.

Although Posner can get away with it, most judges would be afraid to even try.

By doing this Posner is providing cover for other judges.

He knew full well what he was doing. This is very NOT good.

Posner was at one time a respected jurist and legal scholar.
Indeed, I’ve heard he enjoyed being the “most cited legal scholar of the century”

in recent years, he has gone extreme leftie...
you’d think a man would try to get his act together as he neared Meeting His Maker, but this fellow’s apparently preparing to qualify to go to That Other Place instead

it is sad when someone who was once respectable and made some sense...goes commie pinko leftie.... in favor of abortion, homosexual “marriage” and now THIS ultimate abdication of his sworn oath to uphold and defend our constitution

This should get him impeached (removed from the court, retired) ASAP I hope.
