Federal Judge: U.S. Constitution Is Outdated, Judges Should Stop Studying It

According to 7th Circuit Judge Richard Posner in a post published to Slate, U.S. judges should stop studying the Constitution.

“I see absolutely no value to a judge of spending decades, years, months, weeks, day, hours, minutes, or seconds studying the Constitution, the history of its enactment, its amendments, and its implementation,” Posner argued.

“Eighteenth-century guys, however smart, could not foresee the culture, technology, etc., of the 21st century,” he continued. “Which means that the original Constitution, the Bill of Rights, and the post–Civil War amendments (including the 14th), do not speak to today.”

Muhammad Obama hasn’t paid any attention to the Constitution in years.

On the contrary, he's paid very close attention to it in order to find sneaky ways to violate it. That's what his whole career as a "Constitutional scholar" has been devoted to.

Yes, he is a problem, but he did not break any laws, or from what we know, he has not applied his non Constitunal judicial philosophy to any cases.

But when he does, I think the congress will impeach him.

This kind of thinking will fit right in with a "convention of states"...

Should there ever be a convention of states (god forbid) don't think for one minute they wouldn't be there in force too.

I think if we are going to have federal judges ignore the constitution, then we the people should ignore the lifetime appointments clause. Just run these scofflaws out on a rail.

Posner is calling for judicial anarchy. Maybe he needs to be the victim of it.

28 U.S. Code § 453 - Oaths of justices and judges
Each justice or judge of the United States shall take the following oath or affirmation before performing the duties of his office: “I, ___ ___, do solemnly swear (or affirm) that I will administer justice without respect to persons, and do equal right to the poor and to the rich, and that I will faithfully and impartially discharge and perform all the duties incumbent upon me as ___ under the Constitution and laws of the United States. So help me God.”

Does not mean squat unless it’s enforced.

We have tolerated waaay too much for waaaay too long.

This Judge should be removed from the Bench.

Since it’s a compact agreed to by the states that joined to it, and the compact is done, the states can leave.

No “Federal Judges” in it at all.

Just the SCOTUS in Article III

Congress created and can do away with the Lower Courts

Number of SCOTUS judges not specified in there either, a President can appoint dozens if he wants to.

No SCOTUS power to review laws in there either.
