Hillarys ill considered private bathroom email server is lurking out there somewhere and the questions continue to pile up. Thanks to a ruling from a judge today, the former Secretarys IT guy, Bryan Pagliano, will be going ahead with some testimony on the subject. And despite the objections from his legal team, the entire affair will be captured on videotape. (Washington Post)
A federal judge on Tuesday ordered the deposition of a former State Department staffer who helped set up Hillary Clintons private email server to go forward and to be videotaped.
U.S. District Judge Emmet G. Sullivan denied a request by attorneys for technology specialist Bryan Pagliano to bar the recording of the deposition before lawyers with the conservative legal advocacy group Judicial Watch
In his brief order, Sullivan said Paglianos videotaped deposition would be sealed consistent with other interviews. He asked the parties to pick a mutually agreed upon date before the end of June for the deposition, which originally had been planned for June 6.
Just to be clear, this is a completely separate action from the FBIs investigation into possible criminal wrongdoing on Clintons part. This hearing stems from the suit brought by Judicial Watch (who by this point really should be up for some sort of lifetime achievement award in government accountability) claiming that Hillary Clinton undercut the Freedom of Information Act by squirreling away communications in secret which should have been available to the public from her time in the State Department. This civil lawsuit may not land Hillary in the slammer, but it could have other consequences in the long run.

If he has immunity WHY would he be interested in taking the 5th..?

He has immunity for the FBI criminal case...it does not apply to this civil case.
Well, something, somehow, someday should finally land her ass in the slammer.

Pagliano can take the fifth, and he will; that will open the door for the judge to allow Clinton to be deposed.

I dont get it....
Simple. The deposition he took the 5th in is a CIVIL deposition. He has Federal immunity. If he slips up and says something different in a sworn civil testimony versus what he tells the Feds, they cancel the agreement. A person with criminal immunity should only talk to those who control his immunity. Makes legal sense. People get confused sometimes under civil cross examination and it’s easy to say something you don’t mean or is taken out of context.

If he does that, then the type of immunity deal he has is off and cancelled. There are different types of immunity. Immunity is a contract, and if he doesn’t fulfill the type of contract he agreed to, tgen it’s gone.
It will be sealed, but anyways Pas intends to plead the 5th...
As we previously learned, Pagliano only received limited immunity from the FBI, meaning that he couldnt be prosecuted using any of the information he provided to them during their interviews. Hes not free an clear from any prosecution, however, so he can still take the Fifth here.
