(California) CHP says Camarillo woman distracted by phone kills 2 people, gets misdemeanor

MOORPARK, Calif. (KABC) -- Two grieving widows who lost their husbands in what the California Highway Patrol called a distracted driving crash were shocked to find out the driver accused of killing them was charged with misdemeanor manslaughter.

Jesse Cushman, 43, and Maciek Malish, 53, were killed by a car in Moorpark when they were struck by Rachel Hill of Camarillo, according to police.

"My life is ruined, of course, and I don't know how to live without my husband, but at least I expect justice for him," Elizabeth Malish, Maciek Malish's wife said.

It is not illegal to use cell phones while driving. So, it is up to the prosecution to prove that the driver was distracted. More than 40,000 people die in automobile accidents each year. Fact of life.

If anyone cannot drive and talk on their cell phone at the same time because they become distracted then they have no business getting issued a driver’s license.

Not to worry. Plaintiff lawyers will soon come crawling out of the woodwork.

And they probably won’t just sue her. They’ll sue anyone else they can. Might even file a phony lawsuit against the taxpayers of Moorpark, claiming that the road was “dangerous.”

I saw a lady cop in my town this morning,driving a cruiser,and talking on a cellphone.

I had forgotten about it until I saw this post——and will call the police station tomorrow.

I was extremely annoyed-—and I like cops.

Wasn’t CA the state that tried to or maybe even passed a law that, when read in its entirety, the idiots made it so a cop would have to pull over to take a radio call.

Again, the actions of a few idiots will strike those of us that do pay attention - to the law and the phone - while the idiots that ‘don’t give a rats patootie’ continue to use the cell while driving as if they were sitting in their living room.

Gets to be if one passes a car with the driver having a cell phone stuck in their ear, and eating food that requires utensils - sit down food - you get ‘afraid’ to blow the horn cause you may wake up that sorry SOB and they will run into you.

Should be a DUI (Driving Under the Influence) The phone was causing her not to pay attention. This is going to get worse.

Correct. I recently had a court date a month ago at the LA courthouse and I learned about this from my atty. Dismissed. Never mind about the specifics of my violation...

California has several laws banning the use of cell phones (wireless telephones). The first two laws prohibit all drivers from using handheld wireless phones or cell phones and prohibit drivers under 18 from using hands-free cell phones. A third law bans texting while driving.

It's not the talking so much as it is the use of the video features on smartphones. That and negotiating through several menus to get something to work properly.

Another reason to ride a mountain bike on dirt trails.

What are the odds, probably higher than we want to admit.

So sad for the familiies. Right when moms and dads become grandparents and start enjoying the golden years.

Maciek was a client of mine. He was a great guy and very well respected in his profession. His wife, Elizabeth, is still devastated by the loss of her husband.

It is a travesty this criminal only received a misdemeanor for killing two people.

Absolutely true.

Fortunately a lot of the people who have concentration that poor out themselves by calling for cell phone bans on everyone in cars. Their projection makes them easy to spot in some situations, so you know to try to avoid them on the road.

We have several in my church.
