Is There Ample Evidence To Indict Hillary? This Judge (Napolitano) Thinks So

After the latest State Department announcement that Hillary Clinton violated government rules, Judge Andrew Napolitano definitively says there is now ample evidence to indict. Sadly, he is much less certain on whether or not the indictment will actually come.

Here is Napolitano's case as he laid it out to Bill O'reilly:

"Today is a big deal for a couple of reasons. First, it directly refutes a statement she has made dozens of times, 'it was allowed', we now know that it was not allowed. She never even asked."

"She signed a two page statement under oath on her first day on the job which was given after she had a two hour tutorial by two FBI agents telling her about the proper care and legal obligations for state secrets. In that oath she swore that she had the obligation to know how to care for state secrets and to recognize them."

"Here is what's new in the report today. Her server in her house went down a couple of times, and when it went down the blackberry wouldn't work. The state department IT people said 'here use a state department blackberry', and she said through her assistant Huma Abedin 'no because we are concerned with the Freedom of Information Act', so she went dark and she had documents verbally read to her rather than transmitted to her through the state department email system."

When Bill O'reilly was surprised to hear about the fact that Clinton was concerned about having documents subject to FOIA, Napolitano hammers home the the point that now the FBI has intent.

"Now what does this tell the FBI? This shows intent. You don't have to prove intent when you're talking about espionage, you can prove it by gross negligence, there's ample evidence of gross negligence. But avoiding the transparency laws shows a consciousness of evading the requirements."

On whether or not Napolitano believes, after all of the above, that Clinton will actually be indicted, the judge wasn't so sure.

"I believe there's ample evidence to indict her and the only way she wouldn't be is if the president or the attorney general makes a political decision."

And just as we said long ago, Napolitano also believes that one way or another, the FBI will get the evidence out to the public.

"Whether she's indicted or not I believe we'll learn what it is. I believe it'll happen before the Democratic National Convention in Philadelphia, that's two months."

Well then, based on Obama's guarantee that there will be absolutely no political influence in the decision on whether or not the DOJ decides to indict, we should expect the indictment in the coming months... right?

First, let her be nominated by a riotous convention. Then indict her. The Democratic Party will be in chaos. The party will substitute her with someone not Bernie Sanders. His supporters will be enraged and will never vote for her; some will vote for Trump.

If the FBI doesn’t refer her for indictment that’s it the rule of law is dead as a door nail. There is no excuse, we already know of numerous felonies she committed without the mountain of information currently known only to the FBI.

In another thread, I said the odds of her being indicted are less than 1%. The DOJ might take the case to a friendly DC Grand Jury and whitewash the case with a No Bill and thereby let HRC off the hook and make it look like the DOJ did the right thing when in fact they took a fall.

I would put the odds of a flying saucer landing on the White House lawn much higher than HRC getting indicted.

Agreed. Get the Beast nominated, then, indict. Also, there are deadlines for changing a name appearing on the ballot. Even though the slate of electors is what people vote for the name thing would create utter confusion amongst the naturally lower IQ Democrats...

I don't think they're tied into a candidate until they submit the individual state paperwork certifying the nominee for the ballot, something like 90 days before the election. Once submitted, it depends upon the state; many allow substitutions up until x days before the election when the ballots are printed and mailed out.

All that said, why would they substitute in someone else? Someone being indicted by a grand jury? Isn't that par for the course for most Democrats to begin with? And you know the Dixie Mafia would drag Obama out of the WH by his big ears to do an executive pardon for Hillary (brushing off the crimes as ‘politically motivated witch hunt’ since, well, rules only apply to conservatives.)

90 days is very close to the end of their convention. Their convention ends July 28. So they have just about 100 or so days until Nov 8.

I think if she is indicted, something I will believe when I see it, it would be too late to change much of the ballots in several states. Hopefully those states would be California, New York, New Jersey and several other Left leaning states.

Even if she is indicted, most Democrats would still vote for her. They are after all immoral to the core or at least amoral.

It will come to a plea deal. Clinton steps down from the campaign and serves no time.

I bet it goes down like this. Hillary goes to the convention and picks Joe Biden as her vice president. The convention elects the team, shutting out Bernie Sanders. After the convention, Clinton steps aside and Joe Biden goes to the top of the ticket and picks another vice president (ala George McGovern, Eagleton and Shriver).

It won’t work for them, but it’s the only straw the dims have to grasp.

The judge has been saying this very same thing for years! Obviously there’s enough to indict - no news here! We’ve heard all of this before. If Comey does not cave, we’ll get an indictment. But it’s not looking good at this late date. Can’t believe he hasn’t done so already.

If it was a Republican running for President, it would be DEMANDED regardless of who was in the White House. Obama wants to appear as hands-off on this whole thing as much as possible though he probably hates the Clintons and always has. Giving her the SOS job was a pay-off. AG Loretta Lynch has to give the go ahead to indict but she has to appear to be acting on her own legal authority rather than a mandate or advice from her boss.

General Petraus lost his job at the CIA over much less but Hillary's unemployed right now so she can't be punished the same way. If anything, I expect some kind of fine and a stern scolding. Her fan base will vote for her even if she is awaiting trial. Integrity and honesty mean little when the goal is a woman president at all costs. I've said it before that Obama has made the probability of another black man being elected President again won't happen for a long time. Having Hillary as the first woman president will ensure NO woman ever gets elected again.

The Democrat party is on life support, and Barack Obama is monkeying with the IV. He doesn’t care if the patient dies. Due to term limits, Barack has no more use for the Donkey party. He won’t lift a finger to help get a Democrat elected. He don’t do second fiddle. He has bigger plans.

He wants to be the world’s community organizer, and having a foil in the White House fits this plan nicely. Obama will agitate, instigate division, foment unrest and attempt to mobilize the leftist movement in a global way. That’s what this current globe trot is all about. Laying the ground work. Notice how Donald Trump specifically, and America generally, are already the enemy, in his mind.

It is unclear if he will shill for Islam in an open way, or just covertly, but there’s no question he will attempt to benefit Islamic regimes in every way he can.

He’ll work from his home in DC, in the midst of the Great Satan is where he’ll be for a while, but becoming the nominal head of world leftism is his goal. To him, it’s a promotion.

But all narcissists eventually over-esteem their abilities, and just like all the others, he is underestimating Donald Trump, and the resilience of the American people. Oh, and the world doesn’t do affirmative action.

I wonder if the Secret Service will be obliged to protect him when he’s finally behind bars?
