A man is asking for $10 million after spending 529 days in jail for a crime he says he didn't commit.
Darrick McDuffie was accused of shooting a man in 2012 in DeKalb County, but he says he didn't do it and the victim backs up the story.
At one point, police thought McDuffie was responsible for shooting another man so they arrested him and booked him in jail, but there is no mention of him in the initial police report.
"It's a fundamental miscarriage of justice," said Adam Klein, who is McDuffie's attorney. "He was just barely 20-years-old when he went in and he'll never get those two years back."
Klein said his client spent 529 days in jail for a shooting that happened at the Ivey Place Apartments on Clairmont Road. Just two months after his arrest, the victim who was shot in the head shared stunning information with authorities in a sworn affidavit, saying "Darrick McDuffie was not responsible for my injuries..."
"If they're holding someone in jail, they have an obligation to pursue the case or dismiss it and release him," said Klein.
In this case, McDuffie remained in jail for a year and a half before being released. Klein said the county failed to act on the affidavit stating that his client was innocent.
"As far as we know, there was no further investigation, there was nothing else pending, there was nothing being done by the police or prosecutors during that whole time," Klein said. "They had the affidavit and the file went in the drawer and there it sat."
Klein is now seeking $10 million for his client and as far as he is aware, no one else was ever charged with a crime.

This is absurd. It doesn’t matter if he was guilty or innocent. It is immoral to hold someone for a year-and-a-half without CHARGING him and TRYING him. Even if he did shoot the victim, the police there should be culled of several people and the DA should be serving time.

Having spent some time incarcerated, i can tell any of you who haven’t been, if he is innocent, $10 million might cover it.
What are you talking about? No need to be a jerk.
It is true that a lot of blacks will not snitch on other blacks. If you didn’t know that, you are ignorant.
Did the man commit the crime? I really know nothing about the man’s guilt or innocence. Should they have held him? Absolutely not.
I am really not sure what you’re trying to imply. If you’re trying to imply racism, I feel very confident that I will see and talk with a lot more black & white prisoners this month than you. I also feel confident I will do more to help some needy black families this week than you. I have voluntarily given thousands of dollars and my time to help people in the “black” community so please spare me if that’s what you’re implying.

How does that make it reasonable? The people responsible are not going to be paying it, so it’s not punitive. And close to $20,000 a day would be coming out of the pockets of taxpayers who had no control over or even knowledge of the situation. How about if something like that happened where you lived, and your share came to a few thousand dollars. Would that seem reasonable to you?

Agreed. Never mind immoral, there are numerous laws on the books that should put several local government officials behind bars for a decade over this incident. And part of the 10 million (which the victim deserves) should come from their fines. The rest should come directly from the people of DeKalb county, as punishment for tolerating a corrupt and incompetent government. Doesn’t it say somewhere in some important governmental document something about fair and speedy trials?
This was no different than kidnapping, except under color of law.

Ahh...there’s the problem. So, the collective “you” voted for these people...so that’s the end of your responsibility, right?
It happened in a district where politicians and officials that they voted for DID or SHOULD HAVE HAD have control of and knowledge of the situation.
If the citizens are punished financially for making bad choices, perhaps they will wake up and make better choices - that is, “hire” better people who will make better decisions.

That is certainly a possibility. Amazing some on here can’t get that. They really don’t know how it works.
