If Obama nominated someone like Scalia, then I agree. That nominee should get a hearing. However, Obama isn’t going to do that, so the Senate should refuse to act. There’s nothing in the US Constitution that says they must advise and consent. Obama has a constitutional right to nominate whoever he wants. Congress has a right to ignore it.

BTW, George Will is clearly a RINO GOPe member, and this article proves it. Which team are you on, George? Oh, we know the answer to that!

Oh, lest anyone think this nominee isn’t going to be approved, I still think the GOPe will fold like a cheap suit. As soon as it becomes apparent that Trump is the nominee, the GOPe will rush to stack the court with Obama’s pick. They are, after all, the uni-party. Truth: they do not want constitutional conservatives (originalists) any more than Obama.

The cowardly Pubbies in the Senate won’t say the obvious: if the Founders had wanted SC nominations to proceed outside of politics, they would have placed confirmation in the hands of a judicial review panel or similar.

The right answer is: we can stop it, so we will. (a variation on ‘elections have consequences’)

People like him don’t care.

They love rules, power, money, prestige.

They don’t live (or struggle) under the rules, power, money, prestige of others.

Will wants to pretend that the process is more important than the outcome.

The Left plays to control the outcome, and to exercise power.

People like Will play to drink and dine, with the people in power, of course.

Republicans instantly responded to Antonin Scalia's death by proclaiming that no nominee, however admirable in temperament, intellect and experience, would be accorded a hearing.

My money says Will cannot quote a single R in the Congress that made such a statement. Certainly several R's noted they would exercise their Constitutional perogative, but Will's choice of words likely demonstrates an author with an ulterior motive.

I.e., Will is a paid operative, perhaps paid non-monetarily but still paid. (Even if an R did make such a claim, one should wonder why he promotes such a biased view rather than simply conceding that the matter is entirely within the R's well-established options.)

Most of us knew something was wrong and Trump gets a boost every time one of the masks fall off.

For whatever reason John Roberts skewed the U.S.Constitution over Obamacare, causing the worst train wreck of that document ever!

But wouldn't that be a micro-aggression or something?

They are abject cowards. There's no possible way to remove politics from SC nominations or approvals, so just say it!

I imagine even a judicial review panel would not be immune from being politicized. Who picks the panel, for instance?
