True...The present term ends Jan 3 2017. If the Dems win the Senate in November, he can submit a nomination and get it through after the new Senate is seated.

But I think God is on our side.

Just watch out what the other hand is doing in the Dem camp.

The idiot McConnell has already publicly said he next president should make the choice. WHICH MEANS he is already setting the terms of the deal for Obama to make the appointment. If he was planning a serious fight he would not telegraph anything. All he and any GOP pol had to say was they were in full support of Obama’s nominee having a vote.

Article II, Section 2, Clause 3.

It would only last until the end of Congress’s session, but a lot of damage could be done in that time.

My thoughts exactly. A new president will have been elected by then, but not sworn in. The Senate can hold off a few days.

Solution. Don't adjourn.

They have to. It's the end of the 114th Congress.

The time, it actually is The Recess that was argued when Obama tried to recess appoint the National Labor Relations Board a few years ago when Congress was technically in a pro former session.

If Obama did recess appoint, it would only last until 2018 when the Justice must then step down.

What if they don’t adjourn, but remain officially in session (even if nobody is there)?

BTW, January 3 is the dy the new Seante’s terms officially begin.

It is true that Obama can appoint a “Temporary” Supreme Court Justice once the Senate is out of session.

Strategy of the White House: There are many more Republican Senators than Democrat Senators up for election in 2016. It is expected that the Democrats will control the Senate after the election.

Obama will definitely appoint his Supreme Court nominee as a “Temporary Recess Appointment”. Given that the Democrats win the Senate as expected, they will confirm Obama’s nominee. Even if the Democrats do not have enough votes to stop a filibuster, history shows, that they will change the Senate rules to stop the filibuster for a Supreme Court nominee.

It is a sad day in America for our Bill of Rights as our bedrock is on the way out the door by socialist Justices.

A radicalized liberal Supreme Court will rule and base decisions on the US Constitution as a “living” document instead of the static interpretation derived from the founding fathers, meaning the Constitution as we and our fathers have known it is a meaningless document to them.

Not impossible: should the Dems win the Senate decisively enough in November, 0bama could make a recess appointment who would be later confirmed in a newly-Democrat Senate. I am uncertain as to what options a new Republican President would have in that case. Should the Presidency go Democrat as well, it doesn't really matter because they'd do anything they wanted anyway. We have a lot riding on November."

Have to factor in that Cankles and her cadre - which includes Senators - believe that they still have a lock on November, and I guarantee you that her SCOTUS list looks different that his SCOTUS list.
